Burgon as Trustee of The Loa A. Burgon Trust dated March 25, 2008, of 3257 Timeron Drive, Salt Lake City, UT 84128, grantor, for and in consideration of the sum of TEN DOLLARS ($10.00) and other good and valuable considerations, the receipt whereof is hereby acknowledged, does hereby grant and convey unto Fairview Heritage Monument Association, an unincorporated association, of c/o Blair H. Hillstead, 185 Cowpoke Way, Afton, WY 83110, grantee, a perpetual, exclusive easement over, under, across and along the following described parcel of land for the purpose of constructing, erecting, installing, operating, and maintaining the Fairview Heritage Monument "the Monument and its successors and assigns, to enter upon the lands of the grantor, situate in the County of Lincoln, State of Wyoming, said parcel of land being more particularly described as follows, to -wit: Beginning at a point which is the Southwest Corner of the SW1 /4SE1/4 of Section 3, T31 N, R119W of the 6th P.M., Lincoln County, Wyoming, and running thence East along the South boundary line of said SW1 /4SE1/4, 90 feet; thence North parallel with the West boundary line of said SW1 /4SE1/4, 60 feet; thence West parallel with said South boundary line, 90 feet, more or Tess, to the West boundary line of said SW1 /4SE1/4; thence South along said West boundary line, 60 feet, more or Tess, to the point of beginning. 1. Grantee and its successors and assigns are hereby granted the right to construct, erect, install, operate, and maintain the Monument in such size, shape, and form and of such materials as it in its sole discretion may determine. Grantee agrees that after any construction or maintenance it will restore the land to its previous condition as soon as reasonably possible and to the extent reasonably possible. 2. Grantee is responsible for all expenses of construction, erection, installation, operation, and maintenance of the Monument. 3. No other party may use the above described parcel of land for any other purpose without the prior written consent of both Grantor and Grantee. 1 4. Grantee shall hold Grantor harmless from any liability, injury, damage or claim by any person whomsoever using the easement, whether or not such use is with or without the permission, consent or knowledge of the Grantee; excepting, however, any such claim arising from the use of the easement by the Grantor or by persons using the easement with the express permission of the Grantor. 5. The Grantor hereby waives and releases all rights to said property under and by virtue of the homestead exemption laws of this state to the extent that such rights may interfere with the intent of this easement for the purposes stated herein.
