DECREE OF DISTRIBUTION
PURSUANT TO W.S. 2 -1 -205
This hatter comes before the Court on the Application for Decree of Distribution of Claiming
Distributees Hal M. Allred, Morry R. Allred, Gloria Oldham and Jacqueline Mason, by and
through their attorney M. Jason Majors of the Majors Law Firm, P.C. Based upon the
Application for Decree of Distribution, the records in the Court's file, and being otherwise fully
advised of the premises herein, the Court hereby makes the following findings of fact and
conclusions of law:
(1) Elden Morrell Allred, also known as E. Morrell Allred (the "Decedent passed away on
September 18, 2013, and the last place of residence of said decedent was the County of
Madison, State of Idaho;
(2) The value of the entire estate of the Decedent, subject to administration, does not exceed
two hundred thousand dollars ($200,000.00);
(3) No application for appointment of a personal representative is pending or has been
granted in any jurisdiction in this state;
(4) More than thirty (30) days have elapsed since the death of said decedent;
(5) The Estate of Elden Morrell Allred is the owner of the following described real property
situate in the State of Wyoming, County of Lincoln, to wit:
That portion of Lot 4 and Lot 5 of Section 17 and the Southeast quarter of
the Southeast quarter (SE1/4SE1/4) of Section 18, Township 31 North,
Range 119 West of the 6 P.M., Wyoming, lying North of the Crow Creek
County Road No. 12 -141.
Including and together with all and singular the tenements, hereditaments,
appurtenances belonging, but subject to taxes, assessments, covenants,
conditions, restrictions, reservations, right-of-way and easements of sight
or record.
(6) Elden Morrell Allred died testate, and pursuant to the Last Will and Testament of Elden
Morrell Allred dated June 2, 2008, the residuary estate is to be divided in four equal
parts between the claiming distributees, as the surviving children of Elden Morrell
Allred. There are no other distributees of the Decedent having a right to succeed to the
residue of the estate of Elden Morrell Allred under probate proceedings, and Elden
Morrell Allred was not survived by a spouse. Claiming Distributees are entitled to the
delivery of the aforementioned real property.
(7) Pursuant to the sworn report of appraisal, the value of the real property was established
to be $18,500.00.
(8) More than two (2) weeks have lapsed since the first publication of Notice of Application
for Decree of Distribution;
(9) As of the date of this Decree, no objections have been made or filed regarding the
Application for Decree of Distribution, and it appears that the facts stated in the
Application for Decree of Distribution are not in dispute.
NOW THEREFORE, based upon the foregoing findings of fact and conclusions of law, the
Court hereby Orders, Adjudges, and Decrees as follows:
The real property which is the subject of this Decree of Distribution is Decedent's interest in the
following described real property situate in the State of Wyoming, County of Lincoln, to wit:
That portion of Lot 4 and Lot 5 of Section 17 and the Southeast quarter of
the Southeast quarter (SEI SEI /a) of Section 18, Township 31 North,
Range 119 West of the 6` P.M., Wyoming, lying North of the Crow Creek
County Road No. 12 -141.
Including and together with all and singular the tenements, hereditaments,
appurtenances belonging, but subject to taxes, assessments, covenants,
conditions, restrictions, reservations, right -of -way and easements of sight
or record.
The Court finds that the Application for Decree of Distribution is proper and hereby orders,
adjudges, and decrees that the Estate of Elden Morrell Allred's interest in the above referenced
real property situate in the County of Lincoln, State of Wyoming, is hereby distributed to the
following Claiming Distributees, will full right, title, and interest in the property:
An undivided one quarter tenant in common interest to Hal M. Allred, a single man as his
sole and separate property whose address is PO Box 11149, Jackson, WY 83002; an
undivided one quarter tenant in common interest to Morry R. Allred, a married man as
his sole and separate property whose address is 2013 E 200 N, Rexburg, ID 83440; an
undivided one quarter tenant in common interest to Gloria Oldham, a married woman as
her sole and separate property whose address is 2315 Princess Drive, Ammon, ID 83406;
and an undivided one quarter tenant in common interest to Jacqueline Mason, a married
woman as her sole and separate property whose address is 475 Maple Drive, Huntsville,
UT 84317.
A certified copy of this Decree of Distribution shall be recorded by the Claiming Distributees in
the office of the Lincoln County Clerk and thereafter the Decree and the record thereof shall be
presumptive evidence of title to the property.
There being no further matters pending before the Court, the above captioned matter is hereby
closed.
