HomeMy WebLinkAbout978776FIRST AMENDMENT TO THE COVENANTS AND RESTRICTIONS FOR GOVERNING RIDGE VIEW ESTATES 'O CD CO aj 8 3 This Amendment to the Covenants and Restrictions for Governing Ridge View Estates is 0 o made pursuant to paragraph 28 of those certain Covenants and Restrictions for Governing Ridge a View Estates filed on August 13, 2007 in the Office of the Lincoln County Clerk as Receiving No. Ea ID 932065, Book 668, Page 556 (hereinafter referred to as "Covenants and Restrictions The CO CO g 2 Covenants and Restrictions may be amended upon the filing of an amendment approved by two thirds (2/3) vote of all owners of real property located within the Ridge View Estates. The Earl J. Darway Family Trust, Earl J. Darway, Trustee, owns eleven (11) of the fifteen (15) lots located within the Ridge View Estates and the acreage contained within said eleven (11) lots is in excess of two thirds (2/3) of the acreage within said subdivision and thus, pursuant to Paragraph 28 of said Covenants and Restrictions, the Earl J. Darway Family Trust does hereby amend said Covenants and Restrictions as follows: 1. Lots 1 and 2 of the Ridge View Estates are hereby excluded from the Covenants and Restrictions. The Covenants and Restrictions shall have no force and effect on said Lots 1 and 2. The Covenants and Restrictions shall only apply to Lots 3, 4, 5, 6, 7, w 8, 9, 10, 11, 12, 13, 14, and 15 of the Ridge View Estates. Q a 2. Paragraph 2 TEMPORARY LIVING QUARTERS is hereby amended to read as Q w o' follows: �o o 'tx M TEMPORARY LIVING QUARTERS: No owner shall permanently locate a camp U;to O o w O w 12' trailer, 5 wheel recreational vehicle, mobile home or any other form of temporary z w o ,.4 Q I W CO 0 0 d 01 J CO w living facility or structure (hereinafter referred to as "Recreational Vehicles upon the tract covered by the deed to said property; Provided, however, said owner will be permitted to place Recreational Vehicles on any lot temporarily during any calendar year to be used for the owner to reside within said Recreational Vehicle conditioned upon the fact that said Recreational Vehicle cannot be left on the property more than nine (9) months of any year unless said Recreational Vehicle is stored a covered storage building, which storage building shall be constructed pursuant to the building material requirements as set forth herein. The intent being that land owners will be allowed to drill a well, install a septic system and connect said Recreational Vehicle to said water and septic system and reside within their Recreational Vehicle for a period of time not to exceed nine (9) months during any calendar year. The placement of said Recreational Vehicle shall comply with all other provisions of the Covenants and Restrictions relating to maximum height, building set back lines, sanitary and water systems and all other provisions of the Covenants and Restrictions with the exception of the size restriction set forth in Paragraph 4 of said Covenants and Restrictions. 3. Paragraph 30 STORAGE OF RV, BOAT AND TRAILERS shall be amended as follows: STORAGE OF RV, BOAT AND TRAILERS: Except as provided in Paragraph 2 hereof. no RV's, boats or trailers shall be stored and parked on any property located within the Ridge View Estates for a period of time longer than thirty (30) days unless the same is stored in a covered storage building, which storage building shall be constructed pursuant to the building material requirements set forth herein. 2 The above amendments shall amend the Covenants and Restrictions and shall be effective upon the date of filing of the same with the Lincoln County Clerk's Office. IN WITNESS WHEREOF, the undersigned as the owner of Lots 1, 4. 5, 6, 7, 8, 9, 11, 12. 13, and 14 of the Ridge View Estates, which lots comprise more than two thirds (2/3) of the acreage within the Ridge View Estates have hereby executed this amendment this 7 4- -L N day of October, 2014.
