AFFIDAVIT AFFECTING TITLE
Lance T. Harmon, having knowledge of the facts set forth herein and being competent to
testify concerning them, pursuant to Wyo. Stat. §34 -11 -101, being first duly sworn, upon oath,
deposes and says:
1. I am an attorney licensed to practice law in the State of Wyoming.
2. LaMont R. Merritt and Gayle W. Merritt (the "Grantors entered into a contract to
transfer certain real property located in Lincoln County, Wyoming to Larry Wade Fluckiger (the
"Grantee The Grantors executed a Warranty Deed on March 2, 2007 transferring said property
to the Grantee. Said Warranty Deed was recorded on March 12, 2007 with the Lincoln County
Clerk, Receiving #0927524, Book 651 Pages 35 -36. Grantee executed a mortgage dated March 2,
2007 to LaMont R. Merritt as Trustee of the LaMont R. Merritt Revocable Trust dated September
10, 1997, which Mortgage was recorded on March 12, 2007 with the Lincoln County CIerk,
Receiving #0927525, Book 651 Pages 37 -42.
3. The legal description contained in said documents contained a typographical error
which is the subject of this Affidavit to reform and correct.
4. Wyoming Statute §34 -11 -101 permits the recording of affidavits to correct
ambiguities in descriptions of land in recorded instruments.
5. The person appearing by the record to be the current record owner of the property
which is the subject of this Affidavit is Larry Wade Fluckiger.
6. The legal description for the above referenced documents is corrected to read as
follows:
Beginning at a point North 00 Degrees 29.5' West, 360 feet along the section line from the East
Quarter corner of Section Twenty -Three (23), Township Thirty -Two (32) North, Range 119
West of the 6th P.M., Lincoln County, Wyoming, and running thence South 89 Degrees 51.6'
West, 1364.72 feet; thence North 00 Degrees 29.7" West 280.66 feet; thence North 89 Degrees
51.6' East, 1184.72 feet; thence South 00 Degrees 29.5' East, 250.66 feet; thence North 89
Degrees 51.6' East, 180 feet; thence South 00 Degrees 29.5' East, 30 feet to the point of
beginning All being within the South Half of the Northeast Quarter (S'VNE'/) of Section
Twenty-Three (23) as a foresaid. Retaining a 60 foot easement the centerline beginning North 00
Degrees 29.5' West, 360 feet along the section line from the East Quarter corner of Section
Twenty-Three (23), and running South 89 Degrees 51.6 West 720 feet which is identical with the
South boundary of this deed description for 720 feet. Also extending an easement from the end
of Easy Acres Loop Road 60 feet in width and 60 feet South, said road being part of the Easy
Acres Subdivision Phase 1 being part of the Northeast quarter of Section 23 Township 32 North
Range 119 West.
