AMENDMENT. The Owners, for themselves and their heirs or successors and assigns make the following amendment to the Declaration: h. MINIMUM SQUARE FOOTAGE FOR HOMES. Every primary residential dwelling shall have a minimum of 1200 square feet of total above grade finished living area (excluding the garage), and 1200 square feet on the ground floor (the floor just above finished grade). No basement area (having its floor and walls primarily below finished grade) will be considered a part of the finished floor area requirements. For purposes of this Declaration, "finished grade" shall be determined by calculating the average finished grade next to each side of the structure, and using the highest such average as the "finished grade". 2. DEFINED TERMS. The defined terms herein shall be given the meaning as prescribed in the Declaration. 3. RATIFICATION OF DECLARATION. The remaining terms and conditions of the Declaration shall remain in full force and effect.
