83123 ("Assignee") all of Assignor's ove~id~g royalty in all oil, g~ and hydroc~bo~ produced

Together with all right, title and interest of Assignor in, to and under, or derived from, all presemly
existing and valid oil, gas and mineral unitization, pooling, operating and communitization
agreements, declarations and orders, and in and to the properties covered and the units created
thereby, but only insofar as they pertain to the rights to production described above.
Assignor agrees to execute such additional instruments as may be necessary to effect the intent of
this assignment, including instruments required by any governmental authority to conform to
governmental regulations.
TO HAVE AND TO HOLD the same unto the Assignee, its heirs, legal representatives,
successors and assigns.
This assignment shall be effective November 1, 2002 and shall be binding upon and inure to
the benefit of Assignee and Assignor and their respective successors and assigns.
WITNESS the execution of this instrument by the Assignor this ~day of November,
2002.
