By this instrument, the holder: Questar Gas Company 1140 West 200 South Salt Lake City, UT 84145-0360 receives a right to construct, operate, maintain, and terminate an odorant building and 4" natural gas pipeline, on Federal lands described as follows: do eD Sixth Principal Meridian, Lincoln CoUnty, Wyoming T. 21 N., R. 116 W., section 34, NE~,4SWIA. The right-of-way area granted herein is 30 feet wide, 180 feet long and contains .12 acres, more or less. The odorant building site is 10' x 13'. Total acres are .13 acres. This instrument shall, terminate on December 31,2031, unless, prior thereto, it is relinquished, abandoned, terminated, or modified pursuant to the terms and conditions of this instrument or of any applicable Federal law or regulation. This instrument may be renewed. If renewed, the right-of-way shall be subject to the regulations existing at the time of renewal and any other terms and conditions that the authorized officer deems necessary to protect the public interest. Notwithstanding the expiration of this instrument or any renewal thereof, early relinquishment, abandonment, or termination, the provisions of this instrument, to the extent applicable, shall continue in effect and shall be binding on the holder, its successors, or assigns, until they have fully satisfied the obligations and/or liabilities accruing herein before or on account of the expiration, or prior termination, of the grant. '~' '" For and in consideration of the rights granted, the holder agrees to pay the Bureau of ~and Management fair market value rental as determined by the authorized officer unless specifically exempted from such payment by regulation. Provided, however, that the rental may be adjusted by the authorized officer, whenever necessary, to reflect changes in the fair market rental value as determined by the application of sound business management principles, and so far as practicable and feasible, in accordance with comparable commercial practices. Terms and Conditions: a. This grant is issued subject to the holder's compliance with all applicable regulations contained in Title 43 Code of Federal Regulations part 2880. b. Upon grant termination by the authorized officer, all improvements ~hall be removed from the Federal lands within. 90 days, or otherwise disposed of as provided in paragraph (4)(c) or as directed by the authorized officer. c. The stipulations, plans, maps, or designs set forth in Exhibits A and B, dated October 3, 2002, attached hereto, are incorporated into and made a part of this grant instrument as fully and effectively as if they were set forth herein in their entirety. d. Failure of the holder to comply with applicable law or any provision of this right-of-way grant shall constitute grounds for suspension or termination thereof. e. The holder shall perform all operations in a good and workmanlike manner so as to ensure protection of the environment and the health and safety of the public. f. The holder shall construct, operate, and maintain the facilities, improvements, and structures within this right-of-way in strict conformity with the plan of development which was approved and made part of the grant on October 3, 2002. Any relocation, additional construction, or use that is not in accord with the approved plan of development, shall not be initiatedwithout the prior written approval of the authorized officer. A copy of the complete right-of-way grant, including all stipulations and approved plan of development, shall be made available on the right-of-way area during construction, operation, and termination to the authorized officer. Noncompliance with the above will be grounds for immediate temporary suspension of activities if it constitutes a threat to public health and safety or the environment. g.' Any cultural and/or paleontological resource (historic or prehistoric site or object) discovered by the holder, or any person working on his behalf, on public or Federal land shall be immediately reported to the authorized officer. Holder shall suspend all operations in the immediate area of such discovery until written authorization to proceed is issued by the authorized officer. An evaluation of the discovery .will be made by the authorized officer to determine appropriate actions to prevent the loss of significant cultural or scientific values. The holder will be responsible for the cost of evaluation 'and any decision as to proper mitigation measures will be made by the authorized officer after consulting with the holder. h. The Holder shall be responsible for total control of all invasive/noxious weed species on any and all disturbed sites. The Holder is responsible for consultation with the Authorized Officer and/or local authorities for acceptable weed control methods, and shall comply with the following: Use of pesticides shall comply with all applicable Federal and State laws. Pesticides shall be used only in accordance with their registered uses within limitations imposed by the Secretary of the Interior. Prior to the use of the pesticides, the Holder shall obtain from the Authorized Officer, written approval of a Pesticide Use Proposal Plan showing the type and quantity of material to be used, pest(s) to be controlled, method of application, locations of storage and disposal of containers, and any other information deemed necessary by the Authorized Officer. Applicator(s) of chemicals used must have completed the pesticide certification training and have a current up to date Certified Pesticide Applicator's License. Pesticide Application Records for the areas and acres treated must be submitted to the BLM Kemmerer Field Office each year, This includes the following: Brand or Product name EPA registration" number Total amount applied (use rate #A.I./acre) Date of application Location of application Size of area treated Method of treatment (air/ground) Name of applicator Certification number Amount of surfactants or dyes used in spraying operation The record information must be recorded no later than 14 days following the pesticide application and must be maintained for two years. The holder shall seed all disturbed areas with the seed mixture listed below. The seed mixture shall be planted in the amounts specified in pounds of pure live seed (PLS)/acre. There shall be no primary or secondary noxious weed seed in the seed mixture. Seed shall be tested and the viability testing of seed shall be done in accordance with State law(s) and within nine months prior to purchase. Commercial seed shall be either certified or registered seed. The seed mixture container shall be tagged in accordance with State law(s) and available for inspection by the authorized officer. Seed shall be planted using a drill equipped with a depth regulator to ensure proper depth of . planting where drilling is pOssible. The seed mixture shall be evenly and uniformly planted over the disturbed area. (Smaller/heavier seeds have a tendency to drop to'the bottom of the drill and are planted first. The holder shall take appropriate measures to ensure this does not occur.) Where drilling is not possible, seed shall be broadcast and the area shall be raked or chained to cover the seed. When' broadcasting the seed, the pounds per acre noted below are to be doubled. The seeding will be repeated until a satisfactory stand is established as determined by the aUthorized officer. Evaluation of growth will not be made before c°mpletion of the second growing season after seeding. The authorized officer is to be notified a minimum of ten days prior to seeding of the projeCt. All permanent above ground structures at the facility, not subject to safety requirements shall be painted to blend with the natural color of the landscape. The color selected for this project shall match Carlsbad Canyon 2.5 6/2, or be an acceptable substitute pre-approved by the local manager. Standard environmental color charts are available from the local BLM Office. Ninety days prior to termination of the right-of-way, the holder shall contact the authorized officer to arrange a joint inspection of the right-of-way. This inspection will be held to agree to an acceptable termination (and rehabilitation) plan. This plan shall include, but is not limited to, removal of facilities, drainage structures, or surface material, recontouring, topsoiling, or seeding. The authorized officer must approve the plan in writing prior to the holder's commencement of any termination activities. DESCRIPTION OF FACILITY Questar Pipeline Company (Questar) proposes to construct a gate station and associated pipeline near the town of Kemmerer, Wyoming (Section 34, T21N, Rl16W) in Lincoln County. The project will include the installation of new metedregulation equii~ment and building, odorant equipment and building, and approximately 170-feet of 4-inch high pressure natural' gas line. Both buildings will be located within the existing, previously disturbed, equipment yard. The new 4-inch steel pipe will be used to connect the new gate station to the existing 3 inch feededine. To better accommodate the new Questar gate station facility layout, Questar will also be required to relocate an existing power pole, power line, telephone pole and telemetery line located within the yard. Questar's proposed construction is expected to commence in early October 2002, but will not begin until appropriate ROW grants andWritten authorizations are obtained from the BLM. II. DESIGN CRITERIA The new high-pressure feederline will be constructed of 4-inch, epoxy-coated steel pipe. The line will be buried 3 feet (min.) below grade. The new pipe will be installed using typical open trench' techniques. The' new pipeline will also be located parallel to (approximately 15 feet north) an existing 8-inch (non-Questar) pipeline serving the Naughton Power Plant. Installation of the new equipment will also allow for the retirement of an existing valve pit and building previously served by Northwest Pipeline Co. Questar is requesting a 50-foot temporary workspace in addition to the 30-foot permanent right-of-way during construction. No additional access roads will be required for this project. QPC (or approved contractor) ~ehicles or other equipment will access the project along existing county/state roadways and will stay within the approved temporary ROW during construction. Iil. CONSTRUCTION 'OF THE ROW Project construction is planned for October 2002, but not before all permits and ROWs have been secured and weather conditions permit. The construction workforce is expected to be five to ten people. Construction will occur in a planned and orderly sequence of operations along the ROW. Construction will include the following steps: ~.~'~T"' · surveying and staking; · clearing and grading; ~.,,~ trenching; · pipe placement and welding; :~: ;:~',::,~ · backfilling and erosion control; ..:: .~,~ · testing; and .. ~_.-,-~ 'o · cleanup and reclamation. Surveying and Staking Prior to construction, the final pipeline alignment will be surveyed. The right-of-way (ROW) centerline and outer limits/boundaries will be staked as will environmental avoidance areas '(if applicable) and construction control points. Boundary stakes will be maintained until final cleanup and reclamation are complete. Permission will be obtained, as necessary, prior to entering property to conduct any alignment or property surveys. Clearing and Grading Construction activities will begin with the removal of aboveground vegetation, obstacles, and all available topsoil. No clearing or other disturbance will occur outside of the approved ROW area. Vegetation and other materials that are cleared will be placed within the ROW area, for later use in reclamation'and to impede unauthorized vehicle traffic, or will be removed in accordance with landowner directions. Where necessary, cleared vegetation and debris will be disposed of in accordance with all applicable laws and regulations. Topsoil will be segregated from subsoil and stockpiled (windrowed) for use during reclamation. ~ Trenching Crews will begin by opening a trench approximately 2 ft wide and a minimum of 3-4 feet deep. In areas where bedrock may be encountered, the trench will be at least 2 ft deep. S~-oil and topsoil will be windrowed separately along the trench. Gaps may be left in the windrows as necessary to permit natural drainage and prevent excessive water erosion in the event that the construction segment receives runoff from a storm. No spoil or topsoil will be placed in riparian areas or outside of the approved ROW. 2 Pipeline Installation Pipe segments will be strung along the open trench. Pipe segments will be shaped to fit the contour of the trench, aligned and welded in accordance with 49 C.F.R~ Part 129, subpart E, Welding of Steel in Pipelines. Welds will be visually and radiographically inspected by a certified contractor and any defects will be repaired or removed as required by USDOT regulations. Upon completion of welding, field joints will be coated with either a tape wrap or shrinkable sleeve wrap, the pipeline coating will be visually inspected, and any faults or scratches will be repaired. The pipe will then be lowered into the trench. Backfilling and Erosion Control Trench backfilling will be completed using a backfill machine or bulldozer. Backfill will generally consist of the material originally excavated from the trench. In some cases, commercially available backfill material may be used. Rock will not be backfilled directly onto the pipe. Where such rock is encountered, select backfill (e.g., backfill that meets contractor's specifications) will be imported from off-site (e.g., commercial gravel pit) or other ROW areas and placed around the pipe to form a pad. After construction of the pipeline is completed, the work areas will be graded and restored, as near as practicable, to the original contour of the land using the previously removed soil. The original topsoil will be evenly spread over the. disturbed area. Testing The pipeline will be pressure-tested with nitrogen in accordance with DOT regulations after the trench is backfilled. The pipeline will be filled with nitrogen and pressurized to 1.1-1.5 times its designated maximum operating pressure for 4 hours to verify pipeline integrity. Upon completion of the pressure test, the nitrogen will be purged to atmosphere. Cleanup and Reclamation Depending upon weather conditions, clean-up and reclamation will occur as soon as practical. Trash, surplus materials, or other waste debris will be removed from the construction area and disposed of in accordance with federal,~ state, and local requirements and landowner preferences. Seed will be broadcast and raked and/or harrowed to cover the seed. Each species will be planted at an appropriate depth, generally 0.25 to 0.50 inches. In areas where it is not possible to drill seed, seed will be broadcast using a cyclone-type broadcast seeder and seeding' rates wilt be doubled. The seeded area will then be raked with a harrow or chain 3 to cover seed and paCked with a multipacker or similar implemen[ to ensure appropriate soil/seed contact. All seeding will be completed pursuant to eLM specifications. Questar will be responsible for monitoring reclamation success along the ROW. Monitoring will also be conducted to ensure that erosion control, weed management, and revegetation efforts continue to meet the objectives of stabilization and productivity along the ROW. Upon completion of the station project, pipeline markers will be placed if determined necessary. IV. TERMINATION AND ABANDONMENT The project includes the retirement of a valve pit, above ground wooden building and odorant equipment. All equipment currently connects the town of Kemmerer's feederline to the Northwest Pipeline facility. The proposed, new 4-inch pipeline will provide future gas service to the town of Kemmerer. V. MISCELLANEOUS INFORMATION Solid Waste Waste materials such as containers, cans; lunch wrappers, used engine oil, and other wastes from construction activities will be collected daily and disposed of at an approved landfill and/or waste disposal site. Contractors will also provide trash barrels or dumpsters to collect construction site trash (e.g., lunch wrappers), and solid wastes will routinely be removed and disposed of at an approved facility.
