The developer has completed the improvements for this phase in the Development Agreement with Lincoln County during Phase II in the Fall of 2021; therefore, no additional agreement is required for Phase III. The lots will have individual water wells and individual septic systems. The proposed plat is consistent with the provisions of the Wyoming Statutes regarding county subdivisions, including: a. Star Valley Conservation District Review was submitted over 60 days ago. As per LUR 4.6 C3, the time of review has expired. b. Chapter 23 environmental review of proposed water and wastewater systems by Department of Environmental Quality. c. State Engineer’s Office Water Rights Redistribution Plan has been submitted 12-22-2021. d. Development of an entity to maintain subdivision roadway and provide for collection of fees for that maintenance. B. The proposed plat is consistent with the goals and objectives of the Lincoln County Comprehensive Plan, including: a. Orderly land use development C. The proposed plat is consistent with the policies and standards of the Lincoln County Land Use Regulations, including: a. Procedures for Final Plat Application Chapter 4, Subdivisions b. Residential Density Standards for Rural Zone in Table 6.2 including Required Improvements, including i. Construct approved private roads; ii. Installation of electrical and communication lines to lots, and iii. Installation of survey monuments. D. The proposal is consistent with the approved Master Plan, including the satisfaction of the Development Agreement for Oxbow Ranches. BACKGROUND: This Major Subdivision was part of the Master Plan Conditional Use Application consisting of a phased proposal to subdivide 45.93 +/- acres into 9 Residential Lots with an average lot size of 5.1 +/- acres in the Rural Zone. Lots will have individual wells and individual septic systems. Main access to be off County Road 140 Bitter Creek Road. Phasing schedule is as follows: (This was approved 109 MP 21 at the BCC meeting on August 4, 2021.) The road improvements, electrical and communication lines were completed during Phase II. • Phase I – Lots 1-2 Simple Subdivision platting completed in summer 2021. (Approved 8-4-2021) • Phase II – Lots 3-5 Minor Subdivision platting completed in fall 2021.
