PLANNING STAFF: Katie Gipson PROPOSAL: A Simple Subdivision Application to subdivide 5.0 +/- acres into 2 lots with one 2.5+/- acres and the other 2.5+/- acres with an average lot size of 2.5+/- acres in the Rural Zone. The project site is accessed off of Riverview Ranchettes Co. Rd. 173. The lots will be served by individual wells and individual septic systems meeting current state and county standards. The proposed subdivision is consistent with the goals and objectives of the Lincoln County Comprehensive Plan. B. The proposed subdivision is consistent with the standards and procedures of the Lincoln County Land Use Regulations. C. The proposed Simple Subdivision is consistent with the provisions W.S. 18-5-301 through W.S. 18-5-315. AGENCY CORRESPONDENCE: Lincoln County Weed & Pest Control District: Noted due to the snow we are unable to inspect the property. The subdivision representative will need to contact Lincoln County Weed and Pest in the spring of 2022. At that time, we will review a map of the proposed subdivision as well as schedule an appointment to go onsite to evaluate the noxious weeds in the area. The purpose of this visit is to ensure that a weed management plan be in place on the above-mentioned property. Lincoln Conservation District: The Planning Office did not receive any comments from the Conservation District. It has been more than 60 days. I have not had suficient time to thoroughly review the ile, but we do have concerns as an adjoining landowner. These concerns include, but are not limited to, the following: 1. The parcel which is the subject of this application is already within a platted subdivision. All of the lots within the platted subdivision appear to be of signiicantly similar size. Allowing one Lot owner to subdivide into smaller parcels, may set a precedent allowing all additional landowners in the subdivision to submit similar applications. If any of the similar situated landowners choose to submit applications for division, it could double the density of the area and have signiicant impact on the existing subdivision, including trafic, water, road maintenance etc. 2. The subject parcel appears to be in a Rural Zone. Pursuant to Chapter 1 of the Lincoln County Land Use Regulations, β€œThe purpose of the Rural Zone is to maintain the essential rural character of the great majority of the private lands in the county. The zone will provide for agricultural uses combined with low density (typically 5 or more acres average per lot) residential uses, including residential subdivisions where three or more lots are located.” [Emphasis added]. Therefore, the proposed further division of an existing parcel from a 5 acre parcel to two 2.5 acre parcels is not consistent or in accordance with the Lincoln County Land Use Regulations. 3. The Covenants, Conditions and Restrictions of the existing subdivision provide the Lots shall be used solely for private, single-family residential purposes, and there shall not be constructed or maintained thereon more than two single- family dwellings. By approving the proposed application, the subject lot could now include up to four residences on a 5 acre parcel, which is clearly not consistent with the CCRs nor the Laramie County Land Use Regulations.
