PROPOSAL: A Plat Vacation Application to vacate Blocks 1,2,11 and 12, Block 5 – Lot 16, Block 8 –
Lots 21 and 24, which is the remainder of the Berton Townsite including streets and alleys for public use
in Section 14 T26N R113W Lincoln County, Wyoming. This plat vacation is within the Rural Zone. The streets and alleys for public use were vacated at the October 18, 2022 Board of County Commissioners Meeting.
LOCATION: 2 miles southwest of the Town of LaBarge, Wyoming, T26N R113W Section 14

PLANNING STAFF RECOMMENDATION:
Planning Staff recommends that the Board of County Commissioners Approve File #813 AP 22, Vacation of the remainder of the Berton Townsite, with:
● Findings of Approval A. thru D.
● Conditions of Approval 1. and 2.
● Resolution of Approval for Blocks 1, 2, 11 and 12
● Resolution of Approval for Block 8 – Lot 24

FINDINGS OF APPROVAL:
A. The proposed plat vacation is consistent with the provisions of W.S. 18-5-301, et. seq. authorizing
counties to regulate subdivision proposals. B. The proposed plat vacation is consistent with the provisions of W.S.34-12-106 through 110, providing for plat vacation and partial plat vacation where such vacating does not abridge or destroy any of the rights and privileges of other proprietors in said plat.
C. The proposed plat vacation is consistent with the provisions of the Lincoln County Comprehensive
Plan for efficient land use planning. D. The proposed plat vacation is consistent with the provisions of the Lincoln County Land Use Regulations, including: a. Chapter 4, Subdivisions, including plat amendments and plat vacations.
CONDITIONS OF APPROVAL: 1. Block 5 Lot 16 shall be vacated upon applicants providing proof of Lincoln County ownership and transferred to the adjoining land owners.
2. A portion of Block 8 Lot 21 shall be vacated upon applicants providing proof of Lincoln County ownership and transferred to the adjoining land owners. The portion of the lot that is within Lincoln County’s property along Co. Rd. 315 will remain under Lincoln County ownership.

The Office of State Lands and Investments is in receipt of your letter regarding the vacation of the remainder of the Berton Townsite.
Based on the information provided, the site is located adjacent to 640 acres of state-owned land. We note any access across or work performed on state lands will require prior authorization from the state. Apart from this, we have no further comment as the activities are not proposed for lands owned by the state. As always, do not hesitate to contact me with further questions. Sincerely,
