PLANNER: Robert Davis PIN: 2116-122-00-349 _______________________________________________________________________________ PROPOSAL: Applicant is requesting that the Board of County Commissioners approve the vacation of part of a 60-foot road easement across Lot 1 of the Moose Hollow Subdivision and across Lot 3 of the Moose Hollow Second Filing. LOCATION: Approximately ¼ mile north of the city of Kemmerer, WY T21N, R116W, Section 12. ____________________________________________________________________________ EXHIBITS: A. Application B. Map of approximate proposed easement vacation _______________________________________________________________________________ PLANNING STAFF RECOMMENDATION: Planning Staff recommends that the Board of County Commissioners Approve File #103 AP 23 Partial Vacation of Road Easement in the Moose Hollow Second Filing Subdivision Plat with: • Findings of Approval A through D. • A Resolution of Approval Pursuant to Wyoming Statute § 34‐12‐110, the Staff requests the County Clerk to write ‘vacate’ on the subject road easement across Lot 1 of the Moose Hollow Subdivision and across Lot 3 of the Moose Hollow Second Filing based on the findings recommended below. The County Clerk will also make a reference on said plat to the volume and page in which the required instrument of partial vacation is recorded. Moose Hollow Second Filing Subdivision Partial Plat Vacation of Road Easement BCC 2 FINDINGS OF APPROVAL: A. The proposal is consistent with the provisions of W.S. 18-5-301, et seq. authorizing counties to regulate subdivision proposals. B. The proposal is consistent with the provisions of W.S. 34-12-106 through 110, providing for plat vacation and partial plat vacation where such vacating does not abridge or destroy any of the rights and privileges of other proprietors in said plat. C. The proposal is consistent with the provisions of the Lincoln County Comprehensive Plan for efficient land use planning. D. The proposal is consistent with the provisions of the Lincoln County Land Use Regulations, including: a. Chapter Four, Subdivisions, including plat amendments and plat vacations. Moose Hollow Second Filing Subdivision Partial Plat Vacation of Road Easement BCC 3 Discussion The proposed road easement is not currently being utilized by the public and is not anticipated to be used for a road easement in the future. The easement vacation is not likely to negatively affect other property owners and agencies. Initially, the applicant wanted the easement to connect a future driveway from the existing driveway that currently splits to the north. Since access to Lot 1 already exists, there is not a need for the easement. With the vacation of the easement, Lot 3 will increase its buildable space. I I1=--1 ~ t-i~.."..
