HomeMy WebLinkAboutPZC Staff Report 102-CUP-24 Flat Creek RV Park AdditionsLINCOLN COUNTY PLANNING &ZONING COMMISSION STAFF REPORT Conditional Use Permit HEARING TIME AND DATE:6:00 p.m.,January 24,2024 LOCATION:Lincoln County Courthouse,Commissioner Boardroom 3rd Floor,Kemmerer, Wyoming &Afton Planning &Development Office,61 E.5th Ave.,Afton,Wyoming FILE #102-CUP-24 APPLICANTS:Viking Development,LLC ℅David Allred &Trent Veigel PROJECT NAME:Flat Creek RV Park Modification COMMUNITY PLAN AREA:Thayne ZONING:Mixed PLANNER:Emmett Mavy PIN:3419-234-00-178 ______________________________________________________________________________ PLANNING STAFF RECOMMENDATION: Planning staff recommends that the Planning &Zoning Commission send a recommendation of APPROVAL to the Board of County Commissioners for File #102-CUP-24,a proposal to modify three buildings,and add two additional buildings,with Findings of Approval A through D Conditions of Approval 1 through 11 ______________________________________________________________________________ PROPOSAL:To make modifications to the Flat Creek Rv Park in Thayne,Wyoming.The new owners wish to improve the property by adding a new office,moving and expanding their laundry and bathrooms,remodeling their storage building,and adding 10 storage units for rentals.Details of each request is below; Modification to Building #1 This is the storage pole barn at the rear of the property.The size of this building is 32 X 62.This building is in much need of repair and is being used to store seasonal equipment,and heavy equipment.The function of this building will remain the same, we would like to fix it up,put garage doors on it and enclose it. Modification to Building #2 This building includes the bathrooms,laundry room and the well pump equipment.The size of this building is 10 X 30.The laundry room is too small for the amount of use it gets and the bathrooms are terrible.We would like to eliminate the laundry and the bathrooms from this building and put them in building #3.The proposed use for this building will be just to accommodate the well pump equipment and storage. Modification to Building #3 This building is currently being used as the office and storage. The current size of this building is about 50 X 40 which includes a storage lean-to on one side and a garage and lean-to on the other side.We would like to remove the garage and lean-to's on both sides and convert this building into the new laundry facility and bathrooms.This will make the new building size around 26 X 30. Addition of Building #4 This building will be a new addition to the park and will be the new office and mail center.This building will be small.16 X 12.We want the office to be in a better and more visible location.This will also provide a better and safer place to drop off mail and packages. Addition of Building #5 This building will be a new addition to the park and will be a 10 unit storage facility.This building will be 20 X 100 and will provide the opportunity for some of the residents to store their personal belongings on site and help keep the park free of clutter. This project is proposed on a 14.66 acres parcel along FLat Creek in Thayne,Wyoming.Property is within the Mixed-Use zone and appropriate for the requested changes inside their RV Park. Access is from Hokanson Ave a block off HWY 89.Property is adjacent to the city limits of Thayne,WY with residential uses on the North,South,West,and agriculture to the East. LOCATION:The location is roughly 0 miles south of the Town of Thayne,Wyoming,Section 23 T34N R119W. ______________________________________________________________________________ FINDINGS OF APPROVAL: A.The proposal is consistent with the provisions of Wyoming Statute 18-5-203 providing for Board of County Commissioner authority for zoning regulation of buildings and uses of land. B.The proposed use,with conditions,is consistent with the goals and objectives of the Lincoln County Comprehensive Plan. C.The proposed use,with conditions,will not substantially impair the appropriate use of neighboring property;and will serve the public need,convenience and welfare. D.The proposed use is consistent with the provisions of the Lincoln County Land Use Regulations,specifically: a.Chapter 3 Section 3.1 Conditional Use Procedures; b.The provisions for the Thayne Community Plan Overlay Zone; CONDITIONS OF APPROVAL: 1.This permit is to operate the uses outlined in the project description.Significant alterations from the uses described or a modification of structures from the original application shall require additional permitting. 2.The Applicant shall have a StormWater Pollution Prevention Plan on site during construction compliant with WYDEQ. 3.A Wyoming State Fire Marshal “Plan Review”may be required on these commercial buildings and if a plan review is required the plan must be approved prior to running the business in these buildings. 4.Project must meet International Building Code (IBC)and International Fire Code (IFC) Onsite Requirements.An inspection by the Fire Code Inspector prior to operation may be needed.The IBC and Fire Code 2021 /2024 shall be used for the remodeled buildings and new structures. 5.The construction of Building #5 (10 unit storage facility)will require a 25’setback. 6.The construction of Building #4 (Office)will require a 40’setback. 7.Any temporary,moveable,or permanent building,structure,shed or shipping container placed onsite must obtain a Permit from Lincoln County,prior to being moved onto the property. 8.Additional Buffering is not required by the proposed modifications. 9.All buildings must comply with the Lincoln County Lighting Standards as set out in Chapter 6.10 Lighting (includes Exterior Lighting and Glare).All lighting must be shielded from view of vehicles and bulbs not visible from the property boundaries or highway. 10.Outside storage of vehicles or trailers is not permitted in the cul-de-sac area to preserve space for emergency vehicles to turn around. 11.This permit is not approving any signs.All signage must be approved by the Planning department through application of a sign permit.This can be done after approval of the Conditional Use Permit. ______________________________________________________________________________ ATTACHMENTS: 1.Vicinity Map 2.Site Plan 3.Project Narrative and Request 4.Photos 5.Correspondence 6.Old Permits _____________________________________________________________________ BACKGROUND: Flat Creek RV Park has been in Lincoln County a long time and is a grandfathered use.It went through a modification in 1990 to add a cabin and storage building.Today the new owners wish to improve the property by adding a new office,moving and expanding their laundry and bathrooms, remodeling their storage building,and adding 10 storage units for rentals.
