FINDINGS OF APPROVAL: A.The proposal is consistent with the provisions of the Wyoming Statute 18-5-203 providing for Board of County Commissioners authority for zoning of buildings and uses of land. B.The conditional use is consistent with the standards of these Land use Regulations and the goals and objectives of the Comprehensive Plan for Mixed Zone; C.The conditional use will not substantially impair the appropriate use of neighboring property;and will serve the public need,convenience and welfare. D.The conditional use is designed to be compatible with adjacent land uses and the area of its location. CONDITIONS OF APPROVAL: 1.Alteration of the project shall require additional permitting. 2.Lots will be served by the Town of Alpine water system. 3.The “Use of Lots”remains Residential when lots are platted in the Fourth Filing. 4.At Preliminary Plat,the Developer and County shall enter into a Development Agreement to ensure installation of subdivision improvements and preparation of documents. 104-MP-23 Refuge West Fourth Filing -Master Plan,PZC Jan 24,2024 __________________________________________________________________________ PROPOSAL:This is a request to Master Plan the 18.65 Acres Lots 1-6 of the Refuge West 1st,2nd and 3rd Filings.This application is concurrent with a Rezone Permit Application 102-RZ-23 for a rezone from Rural to Mixed.This Master Plan is to split lots 1,2 &6 to create three (3)new lots for a total of nine (9) lots ranging in size from 1.5 acres to 2.14 acres in all four phases.The preliminary plat will require the lots to have Town of Alpine Water,and septic will be determined by Wyoming DEQ and a Chapter 23 Study.Located in Township 37 North,Range 118 West,Section 19 a quarter of a mile from the Town of Alpine,Wyoming. EXHIBITS: ●Applicant’s Application ●Vicinity Map ●Correspondence ____________________________________________________________________________ The Proposed Master Plan A Major Subdivision proposal will move forward if the rezoning and master plan are approved.The applicant proposes to split lots 1,2 &6 in half to create three new lots ranging from 1.5 acres to 2.14 acres in size: ●What is now a 4.01-acre Lot 1 parcel will become Lot 7 (2.0 acres)and Lot 8 (2.01 acres). ●What is now a 4.16-acre Lot 2 will become Lot 9 (2.14 acres)and Lot 10 (2.02 acres). ●What is now Lot 6 at 4.06 acres will be split to create Lot 11 (1.72 acres),Lot 12 (1.5 acres)and a Common Area. The subject parcel will be aligned with other master planned areas including the 2013 Refuge West Master Plan to the east,the 2018 Residential Master Plan to the north and the 2010 Alpine Village Airpark Master Plan to the west. Lots 3,4 and 5 are not proposed to be split. History ●The First Filing consisted of the creation of Lots 1 and 2 only.The First Filing was a Simple Subdivision in its own parent tract. ●The Second Filing was for Lots 3 &4 where Lot 3 was 2.02 acres and Lot 4 was 2.01 acres. This filing was a Simple Subdivision in its own parent tract. ●The Third Filing was for Lots 5 &6 where Lot 5 was 2.05 acres and Lot 6 was 4.06 acres. This was also another Simple Subdivision in its own parent tract. Master Plan Development Conditional Use Permit Application The following information items are required in accordance with the Lincoln County Land Use Regulations, Chapter 3, Paragraph 3.1 B. a. Legal description of property proposed for use; also common street address of property The proposed development is located less than one (1) mile northwest of Alpine, Wyoming, within Section 19, T37N R118W, Lincoln County, Wyoming. The property has access from Old Alpine County Road No. 12-100 via Alpine Village Circle and Funk Fairway. c. Total lot size of area proposed for use, including number of lots applicable. The property is approximately 12.23± acres ( Lots 1 and 2 of Refuge West First Filing, Lots 3 and 4 of Refuge West Second Filing and Lots 5 and 6 of Refuge West Third Filing) d. Current zoning and use of property The property is located in the rural zone. The lots are currently vacant land. An application to rezone the property from rural to mixed has been submitted. e. Current zoning and land uses with a three hundred foot (300’) radius of the property The lands within the 300’ radius are zoned rural and mixed. The property adjoining the eastern boundary is platted as The Refuge (a residential subdivision) and is zoned mixed. The lot sizes are an average of 2.0± acres. The property adjoining the northern boundary is in a rural zone and is used as a single family residence. The majority of the property lying west of Alpine Village Circle is in a mixed zone. The majority of the lots are being used for single family residential with one lot being platted as a townhome development. There is one lot that is zoned as rural and is being used as a single family residence. f. Purpose for which the property is to be used, including the size of the building or buildings, number of occupants and or employees and number of office spaces. The project includes a total of seven (6) residential lots with an average lot size of approximately 2.0± acres. g. All physical improvements required by standards of this document shall require that a performance guarantee be submitted with the application in accordance with performance guarantee procedures of Chapter 6.
