PLANNING AND ZONING COMMISSION MEETING MINUTES Wednesday, March 13, 2024 6:00 P.M. Locations: Video Conference between the following locations: Lincoln County Courthouse, Commissioner Boardroom, 925 Sage Avenue 3rd Floor, Kemmerer, WY & Afton Planning & Engineering Office, Conference Room, 61 East 5th Avenue, Afton, WY
I. CALL TO ORDER Allen called the meeting to order at 6:02 pm. A quorum was established.
II. INTRODUCTION OF PZC MEMBERS Planning Commission Members:
Karen Anderson, Chair Allen Smoot, Vice Chair (Acting) Chad Jensen Tom Crank Pam Price Lincoln County Staff: Marcus Fleming, Planning Director Emmett Mavy, Planner II Elizabeth Williams, Planner II Katie Gipson, Planner I Amy Butler, County Engineer
III. ADOPTION OF AGENDA Marcus welcomed everyone and thanked them for attending. Marcus stated that the agenda would follow
as outlined. Karen made a motion to adopt the agenda. Pam seconded. IV. APPROVAL OF MINUTES
Allen questioned if anyone had any proposed changes to the February 21, 2024 meeting minutes. Karen made a motion to accept the presented minutes. Pam seconded. Tom abstained. Motion carried 4-0. V. DEVELOPMENT REPORT Katie presented the Development Report for January 29, 2024 to February 25, 2024. VI. 101 PZ 24 LAND USE REGULATIONS AMENDMENT, DENSITY AND LOT DESIGN Marcus presented the proposed Land Use Regulation Amendments. Marcus clarified that the proposed regulation amendment would be applicable to those subdivisions not within an incorporated area in Lincoln County. Marcus explained that each proposal could be voted on individually by the Planning and Zoning Commission.
Karen questioned where the proposed regulations came from and if outside entities were included in the discussion. Marcus responded that the Planning Office spoke with other County Agencies and took their input to create the proposed changes. Marcus stated that all proposed regulations coincide with Lincoln County’s
Comprehensive Plan. Chad asked Marcus to clarify the current regulations that require a five-acre average versus the proposed change of a five-acre minimum. Marcus stated that the new proposal would help deter subdivision designs that
include one large lot that gives density to several smaller lots. Chad questioned how this would affect the concern of affordable housing for Lincoln County. Marcus stated that affordable housing is generally found within incorporated areas, and where central water and sewer is available.

Karen brought up concern over the proposed smaller lots for subdivisions in the Rural and Recreational Zone with central water and paved roads. Karen proposed that there be a three-acre minimum and no average.
Karen argued that the proposed changes would just create a smaller more expensive lot. Tom stated that often municipalities are having subdivisions come in with multi- family housing and subdivisions with smaller lot sizes. Tom continued stating that municipalities are the appropriate area for the more affordable housing. Discussion about the different municipalities and upcoming subdivisions within them. Karen asked for a brief overview on Open Space and a flag lots. Emmett explained Open Space and flag lots. Discussion about fire safety followed. Allen opened up the Public Hearing. Robert Hood, Lance Robinson, Melissa Cranney, Dave Hunt, Bonnie Smith, Jamie DeCora, Johnathan Wilkinson, Randi Luthi, and Marlowe Scherbel spoke in opposition to the proposed changes. Preservation of useable open space, preservation of agricultural use, how this affects the affordability of lots, and limited lot design due to topography were the concerns shared.
Allen closed the Public Hearing. Discussion ensued between the Planning and Zoning Commission and planning staff. Chad made a motion that the Planning and Zoning Commission send a recommendation of approval to
the Board of County Commissioners for file 101 PZ 24 Proposal A. with a change in number 4 to remove the wording, “are on a paved road and”, and to ask the Board of County Commissioners to specify a date to start the new density regulations. Pam seconded. All in favor. Motion carried 5-0.
Chad made a motion that the Planning and Zoning Commission send a recommendation of approval to the Board of County Commissioners for file 101 PZ 24 Proposal B. as written including Table 6.1. Pam seconded. Motion carried 4-1. Tom made a motion that the Planning and Zoning Commission send a recommendation of approval to the Board of County Commissioners for file 101 PZ 24 Proposal C. with the amendment that there be no more than two flag lots and they shall not abut each other Pam seconded. Motion carried 5-0. Planning staff stated that the project would go before the Board of County Commissioners on April 3rd. VII. OTHER PLANNING MATTERS ADJOURNMENT Karen made a motion to adjourn. Tom seconded. Motion carried 5-0. The meeting was adjourned at 8:13 P.M.
