Locations: Video Conference between the following locations: Lincoln County Courthouse, Commissioner Boardroom, 925 Sage Avenue 3rd Floor, Kemmerer, WY & Afton Planning & Engineering Office, Conference Room, 61 East 5th Avenue, Afton, WY I. CALL TO ORDER Allen called the meeting to order at 5:58 pm. A quorum was established. II. INTRODUCTION OF PZC MEMBERS Planning Commission Members: Karen Anderson, Chair (Absent) Allen Smoot, Vice Chair (Acting) Chad Jensen Tom Crank (Absent) Pam Price Lincoln County Staff: Marcus Fleming, Planning Director Emmett Mavy, Planner II Elizabeth Williams, Planner II Katie Gipson, Planner I Mikayla Hibbert, Planning Tech / Office Specialist Amy Butler, County Engineer Austin Dunlap, Deputy County Attorney III. ADOPTION OF AGENDA Marcus stated that the agenda would follow as outlined. Pam made a motion to adopt the agenda. Allen seconded. Motion carried 2-1. IV. 103 MS 23 MONARCH MEADOWS Elizabeth presented the Project. Elizabeth presented the Commission with an amended recommendation from planning staff to add Condition of Approval 5 that states, “The developer will construct a 26- foot roadway width”, and to amend the Development Agreement Section 2 to add, “Meet subdivision fencing laws per Wyoming Statute 18-5-319.” Marlow Scherbel, Developer’s Representative, questioned the road way width and if it included the width of shoulders. Discussion between the Developer’s Representative, County Engineer, and planning staff ensued concerning the appropriate way to designate road way width. Elizabeth clarified that the proposed project will have gravel roads and the planning staff are requiring a 26-foot road way width. Discussion between the Planning and Zoning Commission, Deputy County Attorney, and planning staff ensued regarding if there could be a requirement of a 26-foot road way width when it is not in Lincoln County’s current Land Use Regulations. Allen opened up the Public Hearing. Hearing no comments, Allen closed the Public Hearing. Chad made a motion that the Planning and Zoning Commission send a recommendation of approval to the Board of County Commissioners for file # 103 MS 23, a Minor Subdivision Preliminary Plat with Findings of Approval A thru C, Conditions of Approval 1 thru 5, a recommendation for the Board of County Commissioners to sign the Development Agreements, and amend the Development Agreement Section 2 to add, “Meet subdivision fencing laws per Wyoming Statute 18- 5- 319. Pam seconded. Motion carried 3-0. V. 115 MA 23 ZOEY’S LANDING Page 2 of 4 Emmett presented the project. Emmett made amendments to the Staff Report Proposal, and Conditions of Approval to reflect a 26-foot road way width. Emmett explained some of the Conditions of Approval. Chad questioned the designation of commercial / residential on a plat. Emmett answered that this would allow for the lots in the subdivision to have the allowed uses for a Rural Zone as designated in the Land Use Table in the Land Use Regulations. Pam questioned why planning staff was recommending a flag lot when they are discouraged in the Land Use Regulations. Emmett answered that the new recommendation for flag lots allows for 2 per subdivision if they do not abut each other. Emmett explained that sometimes flag lots are the better design depending on the lay of the land; because there is a ditch going through this property it would be a better design to have a flag lot than to disturb the ditch. Pam questioned if the ditch was in an organized district. Emmett answered that it was not and is considered an unorganized ditch. Pam questioned who owned the ditch. Emmett stated that the Developer’s Representative can answer that. Marlowe Scherbel, Developer’s Representative, answered Pam’s question stating that because it is an unorganized ditch, the users of the ditch are the owners. Marlowe stated that the planning office’s design does allow for a smaller culvert and little disruption to the ditch. Chad asked for clarification that the new subdivision layout was suggested by planning staff. Marlowe answered that it was, but that he does not have a problem with the change. Marlowe stated that he disagrees with Condition of Approval 6 because the property is not in the current official FEMA Floodplain. Marcus stated that he has been working with FEMA concerning the current mapped floodplain, and the possible inaccuracies that it has due to the lack of funding. Marcus stated that he has also discussed this with the County’s Emergency Management Office and he was directed to use the resources that were available including the old floodplain. Ryan Erickson, engineer for Sunrise Engineering who performed the Chapter 23 Study, stated that DEQ is requiring enhanced wastewater systems due to the groundwater depth. Ryan stated that the well that was tested came back with a high iron level that is treatable, but that is why Condition of Approval 5 with the Plat Warning from DEQ came from. Allen opened up the Public Hearing. Hearing no comments, Allen closed the Public Hearing. The Planning and Zoning Commission discussed the subdivision design rsuggested by planning staff. Emmett stated that in his discussion with the Star Valley Conservation District they stated they were opposed to the ditch being relocated. Chad made a motion that the Planning and Zoning Commission send a recommendation of approval to the Board of County Commissioners with Findings of Approval A thru C, Conditions of Approval 1 thru 8, and a recommendation for the Board Chairman to sign the Development Agreement. Pam seconded. Motion carried 3-0. VI. SKETCH PLANS a. MAJOR SUBDIVISION, BITTER CREEK RANCHES Emmett introduced the Sketch Plan. Marlowe Scherbel, Developer’s Representative, presented the Sketch Plan. Chad asked how many times this property has been subdivided. Marlowe answered that it has been subdivided six times he believes. There was discussion on if the property could be subdivided further. b. MINOR SUBDIVISION, ALPINE VALLEY VIEW SECOND FILING Marcus introduced the Sketch Plan. Marlowe Scherbel, Developer’s Representative, presented the Sketch Plan. Marlowe stated that there have been three previous divisions of land for this property. VII. OTHER PLANNING MATTERS Chad stated that he would not be in attendance for the April 17, 2023 meeting.
