Plat Vacation HEARING TIME AND DATE: 10:00 a.m., July 2, 2025 LOCATION: Lincoln County Courthouse, Commissioner Boardroom 3rd Floor, 925 Sage Ave.,
Kemmerer, Wyoming & Via Video Conference Afton Branch Office Building Conference Room, 421 Jefferson St., Afton, Wyoming FILE # 812 AP 25

PROPOSAL: This is a request to vacate Lots 1 and 2 of the Mountain Star Subdivision. Lots 1 and 2 are currently being used as a gravel pit. The project site is accessed off of Earl Lane and within the Rural Zone.
LOCATION: Located directly north of the Town of Afton, Wyoming, in T32N, R119W, Section 13.

PLANNING STAFF RECOMMENDATION:
Planning staff recommends that the Board of County Commissioners APPROVE File #812 AP 25, Vacation of Mountain Star Subdivision, with:
● Findings of Approval A. thru D.
● A Resolution of Approval.

FINDINGS OF APPROVAL:
A. The proposed plat vacation is consistent with the provisions of W.S. 18-5-301, et seq.
authorizing counties to regulate subdivision proposals. B. The proposed plat vacation is consistent with the provisions of W.S. 34-12-106 through 110, providing for plat vacation and partial plat vacation where such vacating does not abridge or destroy any of the rights and privileges of other proprietors in said plat.
C. The proposal is consistent with the provisions of the Lincoln County Comprehensive Plan for
efficient land use planning. D. The proposal is consistent with the provisions of the Lincoln County Land Use Regulations, including: a. Chapter Four, Subdivisions, including plat amendments and plat vacations.
AFFIDAVIT OF VACATION
COMES NOW,Aaron Lind in his capacity as President and Managing Member of Mountain Star
Products,LLC,a Wyoming limited liability company,formerly known as Star Valley Rock Products,
LLC,who being duly sworn on oath,according to law,does hereby make the following statement of
facts and affirms:
1.That Mountain Star Products,LLC,is the sole owner of the following described lands:
Lots 1 and 2 of Mountain Star Subdivision as depicted on the plat filed in the Office of
the County Clerk,Lincoln County,Wyoming as Accession No.982259.
2.That in accordance with Wyoming Statutes,2023,as amended.Section 34-12-106,they do vacate
said Plat.
3.That,in accordance with Wyoming Statutes,2023,as amended.Section 34-12-110,the Clerk of
Lincoln County is respectfully requested to write the word "vacated”across face of above Plat and
make reference to the same in the Book and page where it is recorded in accordance with 34-12-
110.
4.That such vacating does not abridge or destroy any of the rights and privileges of other proprietors
in said plat;and provided,further,that nothing contained in this action shall authorize the closing
or obstruction of any public highways laid out according to law.
5.That the Board of County Commissioners of Lincoln County approved said vacation at its regular
in accordance with Resolution No..datedmeetingon
