PROPOSAL: A Conditional Use Permit to build: On Lot 3 Permit No. 104 RUM 18 consists of two (2), 50’x100’ buildings also referred to on the exhibit as No. 1 and 2 Building. No. 1 is used for non-full time residential/apartment with
three (3) bedrooms. Building No. 2 is currently used for Start Bus Storage. Permit No. 508 ZD 19 consists of one (1), 50’x60’ building (referred to on the exhibit as No. 3) and two (2), 50’x100’ buildings (referred to on the exhibit as No. 4 and 5). Building No. 3 is used for museum storage and does not have employees on the premises. Building
No. 4 is used for a cabinet shop and has one (1) employee. Building No. 5 is a truck repair shop and has one (1) employee. Building No. 6 is a storage facility, consisting of one (1), 90’x125’ building. This building is used for long-term storage and may have one (1) employee there at any given time.
Building No. 7, 8, and 9 are proposed buildings and will consist of two (2), 65’x77’ buildings referred to as No. 7 and 8, one (1), 65’x153’ building referred to as No. 9. Building No. 7 and 8 are proposed to be used for trade businesses and storage. Building No. 9 will house the Start Buses.
On Lot 4 Building No. 10 will consist of one (1), 80’x560’. This building (Plaza) is proposed to hold a potential restaurant, retail space and professional offices. There will be parking on
on the east side of the building for delivery trucks.

PLANNING STAFF RECOMMENDATION: Planning staff recommends that the Planning & Zoning Commission send a recommendation of APPROVAL to the Board of County Commissioners for File #103 CUP 26, a Conditional Use Permit, with:
• Findings of Approval A. through D.
• Conditions of Approval 1. through 10. FINDINGS OF APPROVAL: A. The proposed use, with conditions, is consistent with the goals and objectives of the Lincoln County Comprehensive Plan. B. The proposed use, with conditions, is consistent with the provisions of the Lincoln County Land Use Regulations, specifically: Chapter 3, Section 3.1 Conditional Use Permit Procedures.
C. The proposal, with conditions, is consistent with the provisions of Wyoming Statute 18-5-203 providing for Board of County Commissioners authority for zoning regulation of buildings and uses of land. D. The proposed use, with conditions, will not substantially impair the appropriate use of neighboring property; and will serve the public need, convenience and welfare.
CONDITIONS OF APPROVAL:
1. The applicant shall comply with all of the County, State and Federal laws and regulations.
2. Compliance with agency requirements: The developer/owner shall obtain any and all County,
State, and Federal permits, licenses, and other approvals for the construction and/or operation of the project. This may include: Local Fire District, Wyoming Department of Fire Prevention and Electrical Safety (State Fire Marshal), Wyoming State Engineer’s Office (SEO), Wyoming Department of Transportation (WYDOT), Wyoming Game and Fish, Wyoming Department of
Environmental Quality (DEQ), Army Corps of Engineers, Bureau of Land Management (BLM),
and/or Environmental Protection Agency (EPA). 3. Applicants must provide proof of a recorded twenty (20) foot utility easement along US HWY 89 within 90 days of approval by the Board of County Commissioners. 4. Applicants must provide proof of water service from Etna Water District prior to operation of
new commercial operations.

5. Applicants must follow and complete submitted buffering plan prior to operation of any new commercial operations. 6. Any Land Use not specifically stated in this application shall require additional permitting as
directed by Lincoln County Land Use Regulations Chapter 7. 7. Development requires the creation of or participation in a road maintenance agreement for any private road and / or the construction of an access road from Highway 89 to the east end of the project boundary that complies with Lincoln County road design standards. 8. All buildings must comply with the Lincoln County Lighting Standards as set out in Chapter 6.10
Lighting (includes Exterior Lighting and Glare). All lighting must be shielded from view of vehicles on HWY 89 and bulbs not visible from the property boundaries or highway. 9. This permit does not approve any signs. All signage must be approved by the Planning department through application of a sign permit. This can be done after approval of the Conditional Use Permit. 10. This permit is to operate the uses outlined in the permit description. Significant changes to the uses

Condition Use Permit

The following information items are required in accordance with the Lincoln County Land Use
Regulations, Chapter 3, Paragraph 3.1 B.
a. Name and address of the person applying for the permit.

b. Legal description of property proposed for use, also common street address of
property.
The proposed development is part of the Etna Community Area Overlay Zone within the
NW1/4 of Section 14, T35N R119W, Lincoln County, Wyoming. The property is platted
as Lots 3 and 4 of Sherwood Subdivision.
The property has access from US Highway 89 via Sherwood Court. The physical address
is 123 Sherwood Court, Etna, Wyoming 83118.
c. Total lot size of area proposed for use, including number of lots applicable.
The property is approximately 10 ± acres.
d. Current zoning and use of Property
The property is in the rural zone and is platted to be used for Residential/Commercial.
e. Current zoning and land uses within three-hundred-foot 300’ of the property.
The current zoning surrounding the property is rural and mixed use. The land uses within
300 feet of the property are as follows:
South – Commercial
East – Agricultural
North – Vacant
West - Commercial
f. Purpose for which the property is to be used, including the size of the building or
buildings, number of occupants and or employees and number of spaces.
All the buildings located on these two lots are less than thirty-five (35) feet in height.
Lot 3
Permit No. 104 RUM 18 consists of two (2), 50’x100’ buildings also referred to on the
exhibit as No. 1 and 2 Building. No. 1 is used for non-full time residential/apartment with
three (3) bedrooms. Building No. 2 is currently used for Start Bus Storage.

parking spaces, routes for ingress and egress and fencing and screening, if any.

i. Density for the proposed use in term of units per acre and number of offices,
employees, occupants or all three.
A total of nine (9) buildings and the plaza is estimated to have 15 units.
The number of employees or occupants is unknown.
j. Volume in terms of the number of customer and/or deliveries per day.
The existing six (6) buildings generate approximately 15 trips per day and one (1)
delivery. Increasing this type of warehouse to a total of nine (9) buildings would increase
the trips per day to 22.5 and possibly one (1) additional delivery per day for a total of two
(2) deliveries per day.
It is estimated that the plaza will generate 1586 trips at full occupancy (information from
ITE Land Use Code).
k. Any permits, letters or reviews by federal, state or local jurisdictions concerning the
proposal (i.e. Fire Marshal plan review, Health Department, Wyoming Department
of Environmental Quality, Wyoming Department of Transportation.)
No permits, letters or reviews have been issued by other agencies.
l. All applicable development standards spelled out in Chapter 6 of this document
(Land Use Regulations) shall be addressed.
The applicant agrees to comply with the applicable development standards as outlined in
Chapter 6.
m. All physical improvements required by standards of the document shall require that
a performance guarantee be submitted with the application in accordance with
performance guarantee procedures of Chapter 6.
