PROPOSAL: A Master Plan Phased Major Subdivision Planned Unit Development (PUD) for 12
residential dwelling units (Townhomes) to be constructed as International Residential Code (IRC)
Townhouses as approved in File # 101 CUP 23 (apartments) and 510 ZD 25 (permit to construct). The project has an approved Underground Injection Control (UIC) permit for the septic system through the Wyoming Department of Environmental Quality (DEQ) which requires that the applicant submit the results of the monitoring and inspection to DEQ monthly for the leachfields and annually for water
quality and septic tanks. The property is 2+/- acres.
LOCATION: Located 2.3 miles northwest of the Town of Star Valley Ranch, Wyoming in T35N, R119W, Section 10. ____________________________________________________________________________________

PLANNING STAFF RECOMMENDATION: Planning staff recommends that the Planning and Zoning Commission send a recommendation of APPROVAL to the Board of County Commissioners for File # 701 MA 26 Etna Post Townhomes, a Major Subdivision Planned Unit Development, with: ● Findings of Approval A. thru C. ● Conditions of Approval 1. thru 10.
● A recommendation for the Board of County Commissioners to sign the Development Agreement. FINDINGS OF APPROVAL:
A. The proposed subdivision is consistent with the goals and objectives of the Lincoln County Comprehensive Plan. B. The proposed subdivision is consistent with the standards and procedures of the Lincoln County Land Use Regulations. C. The proposed subdivision is consistent with the provisions W.S. 18-5-301 through W.S. 18-5-
315. CONDITIONS OF APPROVAL: 1. The applicant shall have a Storm Water Pollution Prevention Plan on site during construction in
compliance with WYDEQ. 2. A Wyoming State Fire Marshal “Plan Review” is required on all town homes in Wyoming and must be approved prior to construction of townhomes. 3. Project shall meet International Fire Code (IFC) Onsite Requirements for fire flow protection using
the current fire code at the time of construction.
4. The applicant shall demonstrate compliance with WYDOT US HWY 89 improvement requests prior to construction of townhomes. 5. The applicant shall develop road maintenance agreements for road maintenance and snow storage for Clearview Drive that shall be entered into with the Clearview Village residents. Copy shall be
provided to the Planning Office prior to sale or occupancy. 6. A 6-foot opaque wood privacy fence is to be built on the East, West, and North sides of the property to buffer the different uses and densities of the neighboring properties.
7. All buildings must comply with the Lincoln County Lighting Standards as set out in Chapter 6.10 Lighting (includes Exterior Lighting and Glare). This includes all lighting must be shielded and bulbs not visible from the property boundaries.

8. Water must be provided by the Etna Water and Sewer District as per district’s policies and guidelines articulated in the March 16, 2023, letter from the Etna Water and Sewer District to the applicant.
9. The applicant shall provide engineered as built drawings for water service and underground injection systems to the Planning Office prior to sale or occupancy. 10. The applicants shall provide evidence that all conditions of approval have been met prior to sale or
occupancy.
AGENCY CORRESPONDENCE: Lincoln County Weed & Pest: At the time of inspection, Spotted Knapweed, Musk Thistle, and Canada
Thistle are on the property. For all of these species I recommend using Milestone herbicide at 7 oz/acre
and Escort at 1oz/acre. The optimal treatment time would be in mid to late June for Musk Thistle. The optimal treatment time would be around the end of August for Spotted Knapweed and Canada Thistle. If any noxious weeds become present, please take steps to eradicate them.
Star Valley Conservation District:
Due to a large variation between water levels in this section, SVCD recommends soil cuts to determine groundwater levels. If ground water is high, we recommend an enhanced septic system. We also recommend that soil cuts be taken in the spring/early summer when groundwater is highest. If soil cuts
are done at other times know that static water level can fluctuate according to the amount of high-water
runoff from year to year.
Wyoming Department of Transportation: WYDOT has a pending access permit with the applicant for improvement at the Clearview Drive
approach to US 89. It is recommended that approval be conditioned that the US 89 access
improvements be finalized at the completion of Phase 1 construction, prior to any of the applicant’s

RE: Etna Village Subdivision Review – WDEQ# 2026-0042, Lincoln County
Dear Commissioners:
The Wyoming Department of Environmental Quality (WDEQ) has received application materials related
to the Etna Village Subdivision for review of the safety and adequacy of water supply and sewer systems pursuant to
W.S. §18-5-306. The application material was received on February 18, 2026. As described in the statute, WDEQ has
30 days to respond with comments and recommendations; however, if necessary, WDEQ may extend the review
period for an additional 30 days. Due to the increase in current workload, WDEQ's recommendations will be provided
to the Commission by April 19, 2026.
A copy of the subdivision application package has been provided to the Wyoming State Engineer’s Office for their
information and advice to the Water Quality Division.
