PROPOSAL: This is a request to rezone 21 +/- acres, from Rural to Mixed Use to accommodate
Residential / Commercial use of the property. This rezone is combined with file 705 MA 26 a Major
Subdivision concept plan for a residential/commercial subdivision with 47 lots with an average density of 0.61± acres and one park area.
LOCATION: Located directly east of the Town of Thayne, Wyoming in Township 34 North, Range
118 West Section 19, Lincoln Co. Wy

Planning and Zoning Commission made the following action on May 20, 2026:
__X_ Deny the Rezone application stating findings in support of the action; because
1)The proposed rezone is inconsistent with Chapter 1, Section 1.1 A of the Lincoln County Land UseRegulations, which states the purpose of the Rural Zone is to maintain the essential rural character ofthe majority of private lands within Lincoln County. And,

2)The proposed rezone is inconsistent with the intent of the Rural Zone, which allows only homeoccupation businesses and limited low-impact commercial uses that are best suited for rural areas, as
the proposed use was determined to create higher impacts for the neighbors and incompatible with the
surrounding rural character. And,3)The proposed rezone was determined to be inconsistent with the goals and objectives of the LincolnCounty Comprehensive Plan related to responsible and orderly development due to the intensity anddensity of the proposed use within the surrounding rural area.
BACKGROUND:
The property is historically used for agricultural purposes. This rezone promotes and expands residential
/ commercial development near the Town of Thayne along Muddy String.
Merits of the rezone are: A portion of the property is currently located in the Mixed Use Zone, seeking to extend the zone to the property boundary by making a contiguous zoning for the parcel. This
development will provide housing and small business opportunities.
PLANNING OFFICE BACKGROUND
Lincoln County Comprehensive Plan Section II HOUSING:
Objectives:
2. Promote the development of affordable housing and infrastructure concentrating development in andaround existing communities. This Rezone allows for higher density and multi-family buildings thuslower cost per lot for residential uses adjacent to the Town of Thayne.
Lincoln County Comprehensive Plan Section III ECONOMIC DEVELOPMENT:
Objectives: 1. Promote and support the development of infrastructure in and around the towns and communitycenters for the creation and expansion of new and existing businesses. This Rezone allows for a broaderrange for small businesses which may include restaurants and service shops. Which support the
residents of the subdivision and the Town of Thayne.
Lincoln County Comprehensive Plan Section IV LAND USE: Goals: B. Promote the development of residential, commercial and industrial land uses in and around
established central services in the County. This Rezone requires connection to Bedford Water District
and possible future connection to the Town of Thayne centralized sewer system.

FINDINGS OF APPROVAL A. through C:
A.The proposed request is consistent with the provisions of Wyoming Statute 18-5-202(b)
providing that any person may petition the planning and zoning commission to amend anyzoning plan adopted under the provisions of W.S. 18-5-201 through 18-5-208.for thecontinuance and alteration of existing uses of land including public noticing requirements forconsideration by county planning and zoning commission and county board of commissioners.
B.The proposed request is consistent with the goals and objectives of the Lincoln County
Comprehensive Plan:a.Section III ECONOMIC DEVELOPMENT, Goal A. Promote and assist in thedevelopment of commercial, recreational and industrial activities.b.Section IV LAND USE, Objective 1. Create Land Use Regulations that promote theresponsible and orderly development of Lincoln County.C.The proposed request is consistent with the Lincoln County Land Use Regulations, Section 1.4Amendment, Rezone, Subsection B:a.The proposed zone change does not increase burden to existing public road and utilityinfrastructure.
b. The proposed zone change does not unnecessarily extend or increase the cost of servicesprovided by the public.
