The proposed subdivision with a condition, is consistent with the goals and objectives of the Lincoln County Comprehensive Plan. B. The proposed subdivision with a condition, is consistent with the standards and procedures of the Lincoln County Land Use Regulations. C. The proposed Simple Subdivision with a condition, is consistent with the provisions W.S. 18-5- 301 through W.S. 18-5-315. CONDITION OF APPROVAL: 1. Lots 1 and 2 shall access off of Clark Lane Co. Rd. 115 utilizing a shared access meeting WYDOT Highway 89 offset distances. AGENCY CORRESPONDENCE: Lincoln County Weed & Pest Control District: At the time of inspection, Black Henbane, Musk Thistle and Canada Thistle were present. These weeds are on the Wyoming State Noxious Weed list as well as the Lincoln County Noxious Weed List. These plants have been proven to be very invasive and pernicious. According to Wyoming Statute it is illegal to allow any state or county noxious weed to propagate freely. The optimal time for treatment will towards the end of summer after the first hard freeze of the year. The subdivision representative may contact Lincoln County Weed and Pest and discuss their weed control strategy or work with us to devise one. Lincoln County Weed and Pest furnishes herbicides for noxious weed control at a reduced cost share discount to the landowner. We also offer ATV sprayers and 25-gallon pickup sprayers for rent. Star Valley Conservation District: Due to a large variation between water levels in this section, SVCD recommends soil cuts to determine groundwater levels. If ground water is high, we recommend an enhanced septic system. We also recommend that soil cuts be taken in the spring/early summer when groundwater is highest. Please note that if soil cuts are done at other times static water levels fluctuate according to the amount of high-water runoff from year to year. Wyoming Department of Transportation: For the future widening and expansion of state highway the applicant should reflect on the proposed plat US 89 highway right-of-way acquisition and anticipate to set back property improvements accordingly. With the shared driveway easement via CR 115 to serve both Lot 1 and Lot 2, the applicant should remove the existing US 89 access. For any access removal or modification, an access permit must be obtained from WYDOT. Lincoln County Engineer: The primary access point shall be as shown on the plat, serving both Lot 1 and Lot 2 via the shared driveway easement from CR 115. All other existing access points shall be removed. Any access removal or modification on U.S Highway 89 will require permits from WYDOT. The applicant should also show the anticipated U.S. Highway 89 right‑of‑way acquisition area on the final plat and ensure that all future improvements meet the necessary setback requirements associated with planned highway widening. The purpose of this inspection was to see if there are any of the noxious weeds as to W.S. 11-5-102 (a) (xi) . At the time of inspection, Black Henbane, Musk Thistle and Canada Thistle were present.
