PROJECT BACKGROUND Per W.S. 18-5-201. Authority vested in board of county commissioners to promote the public health, safety, morals and general welfare of the county, each board of county commissioners may regulate and restrict the location and use of buildings and structures and the use, condition of use or occupancy of
lands for residence, recreation, agriculture, industry, commerce, public use and other purposes in the
unincorporated area of the county. 1. Planning Office staff was notified of unauthorized commercial sale and/or storage of junk, waste or salvage materials, to include automobiles, RV’s, Trailers and Boats on an unaddressed 5.57-acre lot
located at the northwest corner of Conestoga Road and US Hwy. 89 in Etna, Wyoming.

2. Planning Office staff sent a certified letter via USPS on November 17th, 2025 to Maria Olvera to come into compliance. 3. Planning staff met with the representative to discuss bringing the property into compliance earlier this
year. He expressed their desire to work with the county to come up with a resolution. He also confirmed
that the salvage materials had been moved from Shooting Star RV Park. 4. Planning Office staff revisited the location on September 22nd, 2026, and confirmed there are: 9 bumper-pull and/or 5th wheel campers, 8 vehicles 4 utility trailers, 2 snow mobiles, 1 boat, 1
53’commercial box trailer, and several sets of tires located on the lot without authorized use.
5. Planning Staff did not observe any noticeable progress to come into compliance. DETERMINATION OF VIOLATIONS
Per Wyoming Statute W.S. 18-5-204 violation of W.S. 18-5-202 (c); Continuing Violation
No person shall locate, erect, construct, reconstruct, enlarge, change, maintain or use any building or use any land in violations of resolution or amendment adopted by and Board of County Commissioners. Each day's continuation of such violation is a separate offense.
1. Owner violated the Land Use Regulations chapter 6.8 (h) (siting) by operating a commercial salvage
yard of greater than 5 acres and within 500 feet of a residence without a waiver.
FINE RECOMMENDATION Per Wyoming Statue WS 18-5-206. Penalty for violations of W.S. 18-5-201 through 18-5-204.
Whoever violates any provision of W.S. 18-5-201 through 18-5-204 shall be fined not more than seven
hundred fifty dollars ($750.00) for each offense. Each day's continuation of such violation is a separate
offense. 1. Each violation will be assessed at the rate of $750 per violation per month (rounding up). Violations
began in November 2025 and should conclude in October 2027 for a total of 23 months.
Total fine amount: $17,250 to be paid to Planning Office in full by January 29th, 2027.
REMEDY RECOMMENDATION
1. Owner shall remove all commercial sale and/or storage of junk, waste or salvage materials, to include automobiles, RV’s, Trailers and Boats by October 6th, 2027.
2. If violation continues beyond the deadline established the matter will be referred to the County
Attorney office according to Wyoming statute for continued enforcement.
