PROJECT BACKGROUND Per W.S. 18-5-201. lands for residence, recreation, agriculture, industry, commerce, public use and other purposes in the
unincorporated area of the county. 1. File 105 PZ 20 Conditions of Approval 2 “Prior to the water distribution construction and wastewater collection construction…”
2. File 105 PZ 20 Conditions of Approval 2 “… Landscaping shall be installed along north boundary
consisting of tree clusters each with three or more trees at least four feet tall at intervals sufficient to buffer project”
3. Owners did not construct the site in accordance with the approved project plan. 4. September 22nd 2026 Planning Staff conducted a site inspection and the following were found: six occupied cabins, thirteen camper RV’s some with permanent modifications.
5. In the past two years the owners have always been polite and communicated with Lincoln County
through their representative. DETERMINATION OF VIOLATIONS
Per Wyoming Statute W.S. 18-5-204 violation of W.S. 18-5-202 (c); Continuing Violation
No person shall locate, erect, construct, reconstruct, enlarge, change, maintain or use any building or
use any land in violations of resolution or amendment adopted by and Board of County Commissioners. Each day's continuation of such violation is a separate offense.
1. Owners failed to obtain a WDEQ Chapter 3 Permit for water and wastewater service at the RV Park.
2. Owners failed to install approved buffering along the northside of the property. There are a few trees planted on the northern boundary.
3. Owners failed to follow the initial site plan to include allowing a total of nineteen dwellings (RV’s and cabins), which supersedes approved density.
FINE RECOMMENDATION Per Wyoming Statue WS 18-5-206. Penalty for violations of W.S. 18-5-201 through 18-5-204. Whoever violates any provision of W.S. 18-5-201 through 18-5-204 shall be fined not more than seven hundred fifty dollars ($750.00) for each offense. Each day's continuation of such violation is a separate
offense. 1. Each violation will be assessed at the rate of $750 per violation per year (rounding up). Violations began in 2020 and should conclude in 2027 for a total of seven (7) years.
Total fine amount: $15,750 to be paid to Planning Office in full by January 29th, 2027.

REMEDY RECOMMENDATION 1. The Board of county Commissioners hereby revoke file 105 PZ 20 for violations of conditions of
approval that substantially have an impact on health, safety and welfare.
2. The Board of County Commissioners require the property to be restored to previous permitted use, which is a private single-family residence or obtain proper permitting in accordance with current Land Use Regulations.
3. If no permits are obtained, restoration of previous use, and removal of all unpermitted RV’s, structures and associated vehicles, equipment or items must be completed by October 6th, 2027. 4. If violation continues beyond the deadline established the matter will be referred to the County
Attorney office according to Wyoming statute for continued enforcement.
