HomeMy WebLinkAbout887572 ' 99 BOOK--PR PAGE. ~ NOTICRE fl-/~ '7 ? i517 CIS' I~'ENDENS RECEIVED ::~, ', k. ~ "t Provident Funding Associates, L.P., by and through its attorneys, ROthgerb'er :Johnson' & Lyons LLP, hereby gives notice of a civil action filed on or about January 20, 2003, in the District Court in and for the Third Judicial District, County of Lincoln, State of Wyoming, Civil Action No. 11,123, wherein Provident Funding Associates, L.P., seeks, among other things, a judicial declaration that it is equitably subrogated to all of the rights, securities, priorities, benefits and remedies under a certain real estate mortgage that was fully satisfied and paid by Provident Funding Associates, L.P., and which encumbered the following real property: Commencing at a point which is the Southeast Comer of the NW¼ SE¼ of Section 28, Township 32 North, Range 119 West, 6th P.M., and running thence Northwesterly 20 rods, more or less, to a point which is 7 rods North from the South boundary line of the said NW¼ SE¼, thence West 60 rods to West boundary line of said NW¼ SE¼, thence South 7 rods, thence East 48 rods, thence South 5 rods, thence East 32 rods, thence North 5 rods to the point of beginning. Reserving a 2 rods right of way along the North fence line as an access road, Lincoln County, Wyoming. Said civil action affects the real property because by requesting such a judicial declaration, Provident Funding Associates, L.P. seeks the status of a first mortgagee of the property at issue, superior in time and right to a Mortgage held on the property at issue by the Defendant, Lamont R.
