BLACK, Deceased. Probate No. 4210 DECREE ESTABLISHING RIGHT AND TITLE TO REAL PROPERTY The above entitled matter came on regularly for hearing this //~ KL day of February, 2003, before the Honorable Dennis L. Sanderson, District Court Judge on the application of Affidavit for Distribution of Estate or Decree Establishing Right and Title to Real Property, as heretofore filed by the Petitioners, and the Court, having reviewed the file of record and being duly advised in the premises, finds as follows: 1. That the aforesaid Affidavit or application dated the 31st day of December, 2002, filed with this Court on the 8th day of January, 2003 in accord with §2-1-205 W.S. (1997) applied to this Court for an order authorizing a summary procedure for distribution of certain real property described in full hereafter, is sufficient, complete and in accordance with law. 2. That due and proper notice of this hearing has been given; and that there is on file in the record herein, an Affidavit of Publication showing compliance with §2-1-205(c) (Lexis 2001). 3. That the above named Decedent died on the 21 st day of August, 2002, in City of Kemmerer, County of Lincoln, State of Wyoming. 4. That the Decedent died intestate leaving surviving his heirs at law, the following persons: Name Relationship Betty Black Spouse William L. Black Son Shirley Ellsworth Daughter That the Decedent died seized of an undivided one-half (V2) interest as a co-tenant in the following land located in Lincoln County, Wyoming, to-wit: o Lot 48, Spring Canyon Ranches the same appears of record on the official map or plat thereof filed in the Office of the County Clerk and Ex-Officio Register of Deeds for Lincoln County, Wyoming, together with all improvements and appurtenances thereunto appertaining, SUBJECT TO reservations and restrictions contained in U.S. patents and to easements and rights,of-way of record or in use; SUBJECT TO prior mineral reservations of record; and SUBJECT TO Probate~Black\Decree restrictions governing Spring Canyon Ranches to be filed in the Office of the County Clerk for Lincoln County. AND Lot Numbered Two (2), of Block Numbered Forty (40), of the First Addition to the Town of Kemmerer, as surveyed, platted and recorded; together with all buildings, houses and improvements thereon, or in anywise thereunto appertaining. Subject, nevertheless, to all reservations of coal and mining rights and rights-of-way for removal of coal and minerals, heretofore reserved to predecessors in interest of grantors. That no application for the appointment of a personal representative for the Decedent's estate · is pending or has been granted in any jurisdiction. That the value of the entire estate of said Decedent, wherever located does not exceed one hundred fifty thousand dollars ($150,000.00). That more than thirty (30) days have elapsed since the date of death of the Decedent. That pursuant to the Affidavit for Distribution of Estate, the share of the right, title and interest of Decedent to said real property vested upon his death in said heirs in the following 10. manner: Name Betty Black William L. Black Shirley Ellsworth Share of Decedent's Estate One-half (V2) of the one-half (V2) interest for a total of an undivided one-fourth (~A) interest in each of said properties One-fourth (V4) of the one-half (~A) interest for a total of an undivided one-eighth (1/8) interest in each of said properties One-fourth (IA) of the one-half (1/2) interest for a total of an undivided one-eighth (1/8) interest in each of said properties That no objections, written or oral, have been filed with the Court by any party whomsoever, as to the above captioned matter. Based upon the aforesaid, the Court makes the following: CONCLUSIONS OF LAW 'That the Court has full and complete jurisdiction over the subject matter and all interested Parties in this cause. That the file of record herein is complete and meets all the requirements of {}2-1-205 (1997) for relief prayed for in the application.. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that at the aforesaid date of Probat¢~llack'xDecr¢¢ 2 death of the Decedent. the distributees entitled to this estate are: Name Betty Black William L. Black Shirley Ellsworth Share of Decedent's Estate One-half(V2) of the one-half (V2) interest for a total of an undivided one-fourth (¼) interest in each of said properties One-fourth (¼) of the one-half(½ ) interest for a total of an undivided one-eighth (1/8) interest in each of said properties One-fourth (¼) of the one-half (½) interest for a total of an undivided one-eighth (1/8) interest in each of said properties IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Betty Black, William L. Black and Shirley Ellsworth are the present owners of their share of interest in the below described real property, thereby vesting in said Betty Black, WillLam L. Black and Shirley Ellsworth their share of the interest in the following described real estate situated in Lincoln County, State of Wyoming: Lot 48, Spring Canyon Ranches the same appears of record on the official map or plat thereof filed in the Office of the County Clerk and Ex-Officio Register of Deeds for Lincoln County, Wyoming, together with all improvements and appurtenances thereunto appertaining, SUBJECT TO reservations and restrictions contained in U.S. patents and to easements and rights-of-way of record or in use; SUBJECT TO prior mineral reservations of record; and SUBJECT TO restrictions governing Spring Canyon Ranches to be filed in the Office of the County Clerk for Lincoln County. AND Lot Numbered Two (2), of Block Numbered Forty (40), of the First Addition to the Town of Kemmerer, as surveyed, platted and recorded; together with all buildings, houses and improvements thereon, or in anywise thereunto appertaining. Subject, nevertheless, to all reservations of coal and mining rights and rights-of-way for removal of coal and minerals, heretofore reserved to predecessors in interest of grantors. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that a certified copy of this decree shall be recorded in the Office of the County Clerk; and thereafter the decree and record thereof shall be presumptive evidence of title to the property herein described.
