VAN _A~RSDAJ_~E, JR., ) GEN TU~A Deputy ORDER APPROVING FINAL ACCOUNT AND DECREE OF FINAL SETTLEMENT AND DISTRIBUTION THE ABOVE ENTITLED MATTER coming before the Court for heating on the Final Account and l~etition for Distribution filed herein by Barbara E. Van Arsdale, personal representative of the estate of Byron E. Van Arsdale, Jr., deceased, and it appearing to the Court from the records and files that a Notice of Final Settlement of this estate was given in the manner and for the period required by law as more fully shown in the Affidavit of Mailing on file herein; and it further appearing that said personal representative filed herein her Final Account and Petition for Distribution on the 3 1st day of December, 2002, and that no objections were filed to said Final Account and Petition, and the time for so doing has expired; the court proceeded to the hearing, and being fidly informed and advised, FINDS: 1. That Byron E. Van Arsdale, Jr. (the "Decedent") died testate on or about January 14, 1999, in and a resident of Santa Fe County, State of New Mexico; that the Decedent left real property and estate in the nature of oil and gas interests situated in Natrona and other Counties, State of Wyoming, subject to the jurisdiction of this court. 2. That the decedent left a Last Will and Testament dated September 3, 1991. 3. That on April 8, 2002, Barbara E. Van Arsdale was appointed ancillary personal representative of the Decedent's estate and on May 16, 2002, Ancillary Letters herein; that the time for fili~g 'clmms herein has expired and that no creditor claims were filed herein. 5. That an h~ventory and P-,eport of ~"ppr}isal of Values were made and filed herein as by statute required; that the assets of the estate situate in the State of Wyoming on the date of the Decedent's death, as returned and reported therein, consisted of real property in the nature of oil and gas interests in Natrona and other Counties, Wyoming as more particularly described on Exhibit A attached hereto; that all receipts and disbursements and the accounting thereof made by petitioner during the course of the administration of this estate have been kept in the domiciliary estate; and that the costs advanced by petitioner's attorneys through the filing of this petition were shown on Exhibit B attached to the Final Account. 6. That all costs and expenses of administration have been paid except nnreimbursed costs advanced by petitioner and petitioner's attorneys and except for the fee to petitioner and petitioner's attorneys as shown on the Exhibit B. 7. That there was no tax due to the State of Wyoming as shown by the Certificate of No Tax Due of the Inheritance Tax Commissioner filed herein; that there was no federal estate tax due as shown by the Estate Tax Closing letter filed herein; that all debts of the decedent and all other taxes, if any, have now been paid or due allowance has been made for the payment thereof out of the domiciliary estate. 8. That the Final Account and Petition for Distribution filed herein by the personal representative is in all things true and correct; and all of the acts of said personal representative with respect to the administration of this estate should be confirmed and approved. 9. That this estate has been fully administered upon and is in a condition for final settlement; and that all things have been done or due allowance or provision has been Arsdale Revocable Trust, dated September 3, 1991. That the present trustee of the Trust is Barbara E. Van Arsdale. That the Decedent left three children, to wit: William E. Van Arsdale, Byron E. Van Arsdale, 1I[ and Cory H. Van Arsdale. NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED: I. That all notices required by law have been timely and properly given in these proceedings and that this Court has full, complete and requisite jurisdiction of this estate, the properties herein concerned, and has all jurisdictional prerequisites for the entry of this Decree of Distribution. II. That the Final Account and Petition for Distribution filed herein by the personal representative of said estate, and all of the acts and dealings of said personal representative disclosed therein, including the disbursements made by the personal representative out of the estate be and the same are hereby expressly ratified, approved, settled and confirmed. III. That petitioner be and is hereby allowed the personal representative's fees and petitioner's attorneys are hereby allowed their attorneys' fees herein together with the costs advanced herein, as shown in the Final Account and the payment of such fees and costs is hereby expressly authorized and directed. IV. That pursuant to Article 3 of the Decedent's Last Will and Testament, dated September 3, 1991, the oil and gas interests described on Exhibit A and all of the rest, residue and remainder of the Decedent's property and estate now knoWn or hereafter to be discovered and Wheresoever situate in the State of Wyoming are hereby assigned, set over and distributed to the Trustee of the Van Arsdale Revocable Trust, dated September 3, 1991. That the present trustee is Barbara E. Van Arsdale. That the Decedent left three children, to wit: William E.
