Box 451, Thayne, Wyo~ng 83127, Grantees, the following described perpetual right-of-way easement for the following pu~oses and under the following circumstances: 1. PURPOSE OF RIGHT-OF-WAY EASEMENT. This right-of-way easement is for the purpose of providing a perpetual sixty (60) foot-wide right-of-way easement for ingress and egress from Robinson County Road No. 12-124 to Grantees' lands, described in Paragraph 3 below, including the right to construct and maintain a roadway to provide that ingress and egress. 2. CONDITIONS OF RIGHT-OF-WAY EASEMENT. The conditions of this right-of-way eaSement are: a. That this is a common right-of-way easement for the benefit of Grantors and Grantees; b. That no fences, gates, or other obstructions shall be constructed on or across the easement; CORRECTIVE RIGHT-OF-WAY EASEMENT PAGE 1 OF 3 That Grantors are not providing any maintenance or improvements in connection with the conveyance of the right-of-way easement; d. That this right-of-way easement is not intended to be used for access to a subdivision but for access to homes or other improvements to Grantees' lands so long as a Lincoln County subdivision permit is not required for any division of Grantees' lands; and e. That Grantors may require Grantees to construct a legal fence and gate at the entrance to Grantees' lands to control livestock. 3. pROPERTY BENEFITTED BY RIGHT-OF-WAY EASEMENT. This right- of-way easement is for the benefit of Grantees' real property in Lincoln County, Wyoming, described as follows: MAXINE HEINER, TRUSTEE PROPERTY E1/2SW1/4NE1/4, SE1/4NW1/4, NW1/4NWl/4, and NE1/4NWl/4 of Section 81 and SE1/4SWl/4, SWl/4SE1/4, SE1/4SE1/4, and SWl/4SW1/4 of Section 5, all in T33N, R118W, 6th P.M., Lincoln County, Wyoming. DEON F. HEINER AND CHERYL HEINER PROPERTY W1/2SW1/4NE1/4 of Section 8, T33N, Rl18W, 6th P.M, Lincoln County, Wyoming. 4. DESCRIPTION OF RIGHT-OF-WAY EASEMENTi in Lincoln County, Wyoming, is described as follows: The easement, located A Portion of the El/2 of Section 5, T33N, Rll8W, 6th P.M., located South from Bedford, Wyoming, Lincoln County, Wyoming, more particularly described on the CORRECTIVE RIGHT-OF-WAY EASEMENT PAGE 2 OF 3 attached "DESCRIPTION - CENTER LINE OF 60 FOO~-WIDE HEINER ROAD EASEMENt', a description signed by Lloyd B. 5. BINDING EFFECT. The. terms and conditions of this right-of-way easement shall be binding upon and inure to the benefit of the heirs, successors in interest, and assigns of the Grantors and Grantees. 6. CORRECTIVE EASEMENT. This Corrective Right-of-Way Easement is executed to correct the description of the right-of-way easement that was included in the Right- of-Way Easement that was recorded in Book 402 PR at Pages 685 through 688 of the Lincoln County, Wyoming land records on October 7, 1997.
