HomeMy WebLinkAbout891601Member it 11517 WOit 1733O Section 29, T32N, Rll9W 89160; DISTRIBUTION EASEMENT RECEIVED LINCOLN COUNTY 'CLERK KNOW ALL MEN BY THESE PRESENT: That WE, the undersigned, Tom Peavler and Kelly Peavler, husband and wife, ("Grantor"), for a good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, convey and warrant unto Lower Valley Energy, a Cooperative Corporation, of Alton and Jackson, Wyoming and to its successors and assigns, ("Grantees"), a perpetual easement and right of way for the construction and continued maintenance, repair, alteration and replacement of the electric distribution circuits, lines and equipment of the Grantee to be constructed and maintained under, upon. and across the premises of Grantor in LINCOLN County, State of WYOMING along a line described as follows, to wit: BEING a tract of land located in the SE1/4NE1/4, Section 29, T32N, RI 19W, 6th P.M., Lincoln County, Wyoming, more particularly described as follows: COMMENCING at a point being the NE corner of said SE1/4NE1/4; Thence S 89° 56' 39" W, 517.48 feet to true point of beginning, which is common with the NW corner of Tract 1 of the Map of Survey, Peavler Family Exemption; Thence S 0° 30' 34" E, 704.32 feet to a point and junction vault location. Easement to include a strip of land 20 feet in width running parallel on East side of above described line. Together with all necessary and reasonable rights of ingress and egress and to excavate and refill ditches and trench for the location and repair of said facilities and to cut, trim, or remove trees, shrubbery, undergrowth or other obstructions interfering with the repair and maintenance of the facilities. The Grantor acknowledges that Electric and magnetic Fields (EMF) are naturally occurring in the distribution of electricity, and the Grantee has here notified Grantor that EMF testing and information is available upon request from the Grantee. The undersigned agrees that all wires and other facilities, installed on the above-described lands at the Grantee's expense shall remain the property of the Grantee, removable at the option of the Grantee.
