WAIVER OF PRIORITY OF MORTGAGE
KNOW ALL MEN BY THESE PRESENTS, that as an inducement to KEYBANK NATIONAL
ASSOCIATION "Bank", it's successors and/or assigns, to lend the sum of $50,099.00 to James J.
Sinarski "Borrower", upon the security of a mortgage executed by the Borrower which covers the
following described premises: Situated in the Town/City of Alpine, County of Lincoln and State of
Wyoming and known as:
SEE ATTACHED EXHIBIT "A"
be the same, more or less, but subject to all legal highways. The undersigned hereby consent and
agree with Bank that said mortgage executed and delivered by Borrower to Bank and filed as
Instrument Number (Book, Liber, Volume, etc.) ~? m Page /?~-7 ,
Lincoln County Records shall be the first and best lien on said premises insofar as any claim which
the undersigned now or hereafter have therein, that the undersigned hereby subordinate and waive
priority in favor of Bank,' any right, lien, or interest the undersigned have or claim under a mortgage
dated November 10, 1998 in the original amount of $50,000.00 and filed for record on November
13, 1998 and recorded in Volume 421PR at Page 268, of the Lincoln County Recorder's Office, that
any claim shall be waived in favor of bank as a result of funds advanced or gifts of funds made or to
be made by the undersigned to Borrower and used or to be used for a down payment or otherWise in
the purchase and/or refinance by Bon'ower of the above premises, and that the agreements contained
herein shall bind and inure to the benefit of Bank, its successors and/or Assigns and to the
Undersigned, its successors and/or Assigns, heirs or administrators.
