Assessments are due to the Association on an annual basis. According to the Declaration of Covenants, Conditions and Restrictions for Commissary Ranch ("the Declaration"), dated August 15, 1978, and recorded in the office of the Lincoln County Clerk on September 6, 1978, in Book 149 PR, page 95, ~ecording of a Notice of Assessment and Lien for non-payment of assessments results in a lien on the property of the lot owner in favor of the Association. The Association may foreclose such lien by advertisement and sale under the Declaration. Pursuant to the Declaration and this Notice of Assessment and Lien, the Association has a Lien on the property of the lot owners in the amounts as set forth in the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be iinmediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien or anY part thereof- The names of each of the lot owners, a description of the lots against which the Lien is being impoSed, and the amount due and owing by each lot owner are as follows: Lot Owners Lot Description Amount Owing Commissary Ranch Unit C-3 Lot 38 $210.00 dues T24R116 $11.00 lien fee Total $221.00 Bostick, Edward A.
