According t0 the Decimation o¢ Coven~ts, Conditions and Restrictions for Co~iss~ ~ch ("the Declaration"), dated August 15,' !978, ~d recorded in the office of the Linoola Cowry Clerk on September 6, 1978, in Book 149 PR, page 95, recording of a Notice of Assessment and Lien for non-payment o¢ assessments results a lie~ o~ the prope~ o¢ the lot o~er in favor of the Association. ~]e Association may foreclose such lien by advertisement and sale under the Declaration. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by fhe Lien or any part thereof.
