Each of the p~ies identified below ("lot owners") purchased p~pe~ ~t the
Commissaw Ranch ~d at that time became a member of the Co~iss~fie~d,.
O~ers Association ("the Association"). Assessments me due to the Association on
a~ual b~is. According to the Declaration of Coven~ts, Conditions and Restrictions for
Com~ss~ R~ch ("the Decimation"), dated August 15, 1978, .~d recorded in the
office of the Lincoln County Clerk on September 6, 1978, in Book 149 PR, page 95,
recording of a Notice of Assessment ~d Lien for non-pa~ent of assessments results
a lien on the prope~y of ~e lot o~er in favor of ~e Association. The Association may
foreclose such lien by adve~isement ~d sale under the Decimation. Pursuit to the
Decl~ation and this Notice of Assessment and Lien, ~e Association has a Lien on ~e
prope~ of the lot o~ers in the mounts as set fo~h in the table below.
The lot owners identified below have defaulted in the performance of the conditions
and terms of the Declaration by failing to pay the assessments when due, and thus, the
power of sale has become operative~ and the Association has declared the entire balance
owing for assessments and additional charges to be immediately due and payable and
elects to exercise the power to foreclose the Lien by advertisement and sale as proVided
in the Declaration. No suit or proceeding has been instituted at law to recover the debts
secured by the Lien or any part thereof.
The names of each of the lot owners, a description of the lots against which the Lien
is being imposed, and the amount due and owing by each lot owner are as tbllows:
