According tothe Decl~aion of Coven~ts, Conditions ~d Restrictions for Co~iss~ R~ch ("the Declaraion"), dated August 15, 1978, ~d recorded in the office of the Lincoln County Clerk on September 6, 1978, in Book 149 PR, page 95, recording of a Notice. o~ Assessment ~d Lien for non-payment of assessments results in a lien on the prope~y of the lot owner in favor of the Association. ~ Association may ~omclos~ such lien by advemisement and sale under the Declaration. ~ursu~t to the D~cl~ation ~d this Notice of Assessment ~d Lien, the Association has a Lien on the prope~y of the lot omers in the mounts as set fo~h in the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
