Assessments are due to ~e Association on an a~ual basis. According to the Decl~ation o~ Covenants, Conditions ~d Rest~ctions ~or Co~iss~ Ranch ("the Decl~ation"), dated August 15, 1978, and recorded b the o~ce of the Lincoln Co~ty Clerk on September 6, 1978, in Book 149 PR, page 95, recording o~ a Notice of Assessment ~d Lien for non-payment of assessments results in a lien on the prope~ of the lot o~er in ~avor of the Association. The Association may ~oreclose such lien by adveaisement and sale under the Decl~ation. Pursuant to the Declaration and t~s Notice of Assessment ~d Lien, the Association has a Lien on the property o~ the lot o~ers in the amours as set ~oah in the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
