Assessments are due to the Association on ~ual basis. According to the Declaration of Coven~ts, Conditions and Restrictions fOr Commiss~ Ranch ("the Decl~ation"), dated Au~st 15, 1978, ~d recorded in the office of the Lincoln Co~ Clerk on September 6, 1978, in Book 149 PR, page 95, recording of a NOtice of Assessment and Lien for non-pa~ent of assessments results a lien on the proper~ of the lot o~er in favor of the Association. ~e Association may foreclose such lien by adveaisement ~d sale under the Decimation. Pursuant to the Declaration and this Notice of Assessment ~d Lien, the Association has a Lien on the proPe~y of the lot owners in the mounts as set foah in the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No Suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
