Accord~g to the Declaration of Covenants, Conditions ~d Restrictions for Commiss~ R~ch (',the Decimation"), dated August 15, 1971, and recorded in the office of the Lincoln Conn~ Clerk on September 6, 1978, in Book t49 PR, page 95, recording of a Notice of Assessment ~d Lien for non-payment of assessments results a lien on the property of the lot o~er in favor of the Association. ~e Association may foreclose such lien by adve~sement ~d sale under the Decimation. P~suant to the Declaration ~d this NotiCe of Assessment ~d Lien, the Association has a Lien on the prope~y of the lot o~ers in ~e mounts ~ set fo~h in the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become oPerative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
