Accordin8 to the Decimation of Covenants, Conditions and R~stfictions for Commiss~ Ranch ("the Declaration"), dated Aufust 15, 1978, ~d recorded in the o~ce of the Lincoln Co~ Clerk on September 6, ]9~8, in Book 149 PR, ?aBe 95, recordin~ of a NOtice o~ AssessmeN ~d Lien for non-payment of assessments results in a l~en on the property of the lot owner in ~avor of the Association. The Association may Drec]ose such lien by adve~isement and sale under the Declaration. 'P~suant to the Declaration and this Notice o~ Assessment and Lien, the AssociN~on has a L~en on the prope~ of~e lot o~ers i~ ~e ~o~ts as set forth in the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
