Assessments ~e due to the Association on a~ual basis. According to the Declaration of Coven~ts, Conditions and Restrictions for Co~issa~ R~ch ("the Declarmion"), dated August 15, 1978, and recorded in the office of the L~coln Cotm~ Clerk On September 6, 1978, in Book 149 PR, page 95, record~g of a Notice of Assessment ~d Lien for non-payment of assessments results in a lien on the property of the lot owner in favor of the Association. The Association may foreclose such lien by adve~isement and sale under the Decimation. PursUant to the Declarmion ~d t~s Notice of Assessment and Lien, the Association has a Lien on the prope~y of the lot omers ~ the mo~ts as set fo~h in ~e table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the AssOciation has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. 'No suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
