Co~iss~ Ranch and at that time became a member of the Co~mssar~ch,&a~d~lO
Omters Association ("the Association"). Assessments ~e due to ~e Association on ~
a~ual basis. According to the Declaration of Covenants, Conditions and Restrictions for
Commissa~ Ranch ("the Declarmion"), dated August 15, 1978, ~d recorded in the
office of the Lincoln County Clerk on September 6, 1978, ~ Book 149 PR, page 95,
recording of a Notice of Assessment ~d Lien for non-payment of assessments results in
a lien on the prope~ of the lot o~er in favor of the Association. The Association may
foreclose such lien by adve~isement and sale under the Declaration. Pursuant to the
Declaration ~d t~s Notice of Assessment and Lien, the Association has a Lien on the
prope~ of the lot omers in the amo~ts ~ set fo~h in ~e table below.
The lot owners identified below have defaulted in the performance of the conditions
and terms of the Declaration by failing to pay the assessments when due, and thus, the
power of safe has become operative, and the Association has declared the entire balance
owing for assessments and additional charges to be immediately due and payable and
elects to exercise the power to foreclose the Lien by advertisement and sale as provided
in the Declaration. No suit or proceeding has been instituted at law to recover the debts
secured by the Lien or any part thereof.
The names of each of the lot owners, a description of the lots against which the Lien
is being imposed, and the amount due and owing by each lot owner are as follows:
