Each of the panics identified below ("lot owners") purchased property at the
Commissary Ranch and at that time became a member of the
O~ers Association ("the Association"). Assessments '~e due to the Association on
a~ual basis. According to the Decimation of Covenants, Conditions and Restrictions for
Co~issa~ R~ch ("the Decimation"), dated August 15, 1978, and recorded in the
o~cc of the Lincoln Coun~ Cler~ On September 6, 19~S, in Book 149 PR, page 95,
recording of a Notice of Assessment and Lien for non-payment of assessments results in
a li¢~ on the propeay of the lot o~¢r in favor of the Association. The Association ~ay
foreclose suci~ lien by adveaisement and sale ~der the Decimation. Pursuit to the
Declaration and this Notice of Assessment and Lien, the Association has a Lien on the
propeay of the lot o~¢rs in the ~ounts a set foah in the table below.
The lot owners identified below have defaulted in the performance of the conditions
and terms of the Declaration by failing to pay the assessments when due, and thus, the
power of sale has become operative, and the Association has declared the entire balance
owing for assessments and additional charges to be immediately due and payable and
elects to exercise the power to foreclose the Lien by advertisement and sale as provided
in the Declaration. No suit or proceeding has been instituted at law to recover the debts
secured by the Lien or any part thereof.
The names of each of the lot owners, a description of the lots against which the Lien
is being imposed, and the amount due and owing by each lot owner are as follows:
