According to the Declaraion of Covenants, Conditions and ~estdctions ~or Co~iss~ ~ch ("the Declaration'), daed August 15, 197~, and recorded in the office of the Li~col~ County Clerk on September 6, 1978, in Book 149 P~, page 95, . recording o~ a Notice o~ Assessment ~d Lie~ ~o~ non-payment of assessments resnlts a lien on the propeay o~ the lot o~er in ~avor o~ the Association. The Associaion may ~omclose such lie~ by advertisement and sale ~dCr the Declaraion. Pnrs~t to the Declaraion and this Notice o[ Assessment ~d Lien, the Association has a Lien on propeay of the lot o~crs in the ~on~ts as set ~orth ~ the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay the assessments when due, and thus, the power of sale has become operative, and the Association has declared the entire balance owing for assessments and additional charges to be immediately due and payable and elects to exercise the power to foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien .or any part thereof.
