Lincoln Self Reliance, Inc., a Wyo~ning Non:Profit Corporation, Grantor,
(hereinafter referred to as LSR) does hereby grant to the Town of Alton, a W)gOil~lm~ : ,.-., v i,] L R
Municipal COrporation, in consideration of the Town of Alton obtaining a Con'nnumty
Development Block Grant in the sum of $250,000.00, to provide the funds to the Grantor
for the purchase of an office building, according to the terms thereof and the provision of
the Community Development Block Grant Agreement between the WYOMING
BUSINESS COUNCIL, dated the 12"' day of September, 2003, does hereby grant a lien
to :the Town of Afton on the following described real property situated in Afton, Lincoln
County, Wyoming, to-wit:
Lot 24 of the Airport addition of the Town of Afion Third (3'a) Filing,
Lincoln County, Wyoming as described on plat # 891662 of the Office of the Clerk of
Lincoln County Records..All Real Property and Fixtures attached thereto
Hereby releasing and waving all rights in and to said property under and by virtue
of the homestead exemption laws of the State of Wyoming, together with all privileges,
hereditaments, tenements and appurtenances thereunto belonging or in any wise
appertaining together with all buildings and improvements and fixtures now thereon or
which may hereafter be erected thereon, together with all rents, issues, revenue, income
and profits from and of said property. LSR expressly agrees that all items now and
hereafter attached or connected in or with each building on said premises shall be
considered fixtures and subject to the force and effect of this mortgage.
LSR expressly covenants that: Nothing shall be done on or in cormection with
said property which may impair Town's security hereunder; all said property shall be
continuously maintained in good order, repair and condition by LSR at LSR's expense;
said property shall at all times be kept so occupied as to keep effective all insurance
policies, and devoted to lawful use only; LSR shall pay as due all taxes, assessments and
other legal burdens levied, assessed or imposed against said property, will keep all
thereof insured against lOss or damage by fire or other casualty, all loss under such
policies to be payable to Town.
This Lien is in favor of the Town of Afton in the sum of $250,000.00.
This Lien shall remain in full force and effect for a period of five (5) years. In the
event LSR shall make the decision within said five (5) years to dispose of the facility, the
Grantee muSt obtain the consent of the Wyoming Business Council and the Town of
Alton before LSR is authOrized to dispose of the real property hereinabove described
with improvements thereon.
LSR shall pay as due.all items, non-payment of which as due might subject Town
or said property to claim of lien or other actionable liability. LSR will not permit said
property or any part thereof, to be used in an improper manner or contrary to any law or
ordinance.
LSR may assign their interest herein only with the written consent of Town.
Time and manner of performance are of the essence hereof, and all covenants of
LSR run with the land, and all provisions hereof sliall be respectively for the benefit of
and binding upon the heirs, successors, legal representatives and assigns of the LSR and
Town.
IN WTINESS WHEREF, Lincoln Self Reliance, Inc., has caused this Lien to be
executed and delivered this 12"' day of September, 2003.
