That he is now, and was at all times herein mentioned a duly appointed qualified and acting Deputy Sheriff of Lincoln County, Wyoming.. 2. That the Mortgagee caused a notice of the following described mortgage foreclosure sale to be published once a week for four consecutive weeks, in the Star Valley Independent, a newspaper printed, published and of general circulation in the County of Lincoln, State of Wyoming, the said publication having been made on September 25, October 2, October 9, and October 16, 2003; that said Notice of Mortgage Foreclosure Sale was given in the manner and for the time required by law; that all acts had and done hereunder were in accordance with and conformity to the .requirement of law in such case made and provided; and that 'Proof of Publication of said Notice of Mortgage Foreclosure Sale, together with a true copy of said Notice, is attached hereto, marked Exhibit "A", and by this reference made a part hereof. 3. That on the 27th day of October, 2003, at the hour of 10:00 o'clock a.m. at the front door of the Courthouse of the County'of Lincoln, State of Wyoming, in Kemmerer, Wyoming, the same being also the place of holding Court in said County, and at public venue, to the highest bidder for cash, he offered the sale the following described lands and premises as a whole, and then sold said lands and premises as a whole for the sum of ~ :~': ~-~7 ( ¢ , Lo& , having bid fairly and in good faith therefor, and being the highest and best bidder, for all of said lands and premises; being particularly described as follows, to-wit: Part of Section 18, T34N R118W, Lincoln County public records described as follows: Beginning atthe SouthweSt Corner of the N½S½ of said Section 18 and running thence North 200 feet, thence East 285 feet; thence South 200 feet; thence West 285 feet to the point of beginning. 4. That said lands and premises were sold pursuant to the a above provisions of the Notice of Mortgage Foreclosure Sale hereinabove described, and under and by virtue of the power of sale and authority contained in that certain mortgage deed, dated January 17, 2003, made, executed and delivered by Dick W. Campbell and Jan M. Campbell, husband and wife, as Mortgagors, to The Bank of Star Valley, as Mortgagee, which mortgage deed was filed for record in the Office of the County Clerk and Ex- Officio Register of Deeds within and for Lincoln County, Wyoming, in Book 511 at Page 730; and that the debt secured by said mortgage deed at the time of said sale, including 693 principal, in_tare, st, advanCes, fees, costs and expenses of foreclosure was the actual sum of '~, Y7~, 6.._~ ,as follows: Amount due on Principal Interest to Date of Sale Property Taxes Publication of Notice Sheriff's Fee Recording Costs Attorney Foreclosure Fee and Costs TOTAL $ '--'~.. Bowers of Bowers Law Office, P.C., Attorney at Law, and attorney admitted generally to practice in the State of Wyoming and representing the Mortgagee, and affidavit duly made and executed pursuant to the provisions of Section 34-3-112, W.S. 1977, and executed true copy of which affidavit is attached hereto, marked Exhibit "B", and by this reference made a part hereof. 6. That prior to the aforesaid sale of the within described lands and premises, there was also duly filed with said Sheriff, afffiant herein, by said John D. Bowers, Attorney representing Mortgagee, and affidavit of mailing of Notice of Intent to Foreclosure Mortgage by Advertisement and Sale, and affidavit being duly made and executed pursuant to the provisions of Section 34-4-103, W:S., 1977, an executed true copy of which affidavit is attached hereto, marked Exhibit "C", and by this reference made a part hereof. 7. Campbell a'nd Jan M. Campbell, husband and wife will be foreclosed by a sale to the highest bidder at a public auction of the premises described pursuant to the power of sale contained in the Mortgage. If you, as the Mortgagor, wish to contest said sale, then you must challenge said sale by filing a lawsuit in a court of competent jurisdiction. The Modgage was filed in the official records of the Lincoln County Clerk for and in the County of Lincoln, State of Wyoming, in Book 511 PR on Page 730, as Instrument number 887428 on February 5~", 2003. The Mortgage encumbers real properly situated in Lincoln County, Wyoming, and any improvements and other propedies and interests therein and thereon, which real property is more fully described as follows' Part of Section 18, T34N R118W, Lincoln County public records described as follows: Beginning at the Southwest Corner of the N¼S½ of said Section 18 and running thence North 200 feet; thence East 285 feet; thence South 200 feet; thence West 285 feet to the point of beginning. The above sale will be conducted by the Sheriff or the Sheriff's deputy at the front door of the Lincoln County Courthouse in Kemmerer, Wyoming, at t0:00 a.m. on October 27"', 2003. Dick W. Campbell and Jan M. Campbell, husband and wife, have defaulted in the terms of the Note and Mortgage, and as of the date of this Notice, the undersigned claims an outstanding balance of lhirty-five thousand, nine hundred sixty-nine dollars and forty-eight cents ($35,969.48). Interest continues to accrue on the unpaid balance Page ! of 2 0L2 : 4'74'7 at the rate of $2.29 cents per day. In addition to the unpaid principle, interest and accruing interest, the Modgagor is seeking the costs and reasonable attorney fees associated with the collection and foreclosure of this Mortgage.
