HomeMy WebLinkAbout895131IRRIGATION EASEMENT 895131 RECEIVED :LINCOLN COUNTy CLERK Know All Men By These Presents: dcANN~- That for and in consideration of the sum ofTen Dollars ($10.00) and other the receipt of which is hereby ac~owledged and confessed, Ron Anderson, Trnstee of the Ilia Dixie Anderson Revocable Trust dated the 1Ph day of March, 1997, of the County of Lincoln and State of Wyoming, hereinafter called the grantor, hereby grants to THE LEGALLY ENTITLED WATER ~GHT HOLDERS to the No~h Canal and or the Spring Canal as located in Sections 30, 19, 18, 7, & 6, Township 32 No~h, Range 118 West and Sections ~, ~, & 29, Township 33 No, m, Range 118 West of the 6th P.M., Lincoln County, Wyoming, its assigns or successors, hereina~er called the grantee, the right to lay out, construct, inspect, operate and maintain litigation facilities, and the right to dispense inigation waters For the benefit of the grantee, being over, across and upon the following described lands located in the Coun~ of Lincoln and $tate of Wyoming, to-wit: The easement hereby granted being more pa~icularly described as follows: A pomion of the SW¼SW~ of Section 32, T. 33 N., R. 118 W. of the 6'h P.M., Wyoming, lying between the presently existing no~herly right-of-way boundaw of Wyoming State Highway No. 23? and a parallel right-of-way line 41.97 feet to the left or nomherly side when measured at right angles to the following described su~ey line of highway. Said parallel right-hr-way line begins on the west boundaw of a tract of land described in Book 395 PR at Page 369 of the Lincoln County Records and ends in said SW~SW%: Commencing at the west quarter comer of said Section 32 from which the southwest comer thereof bears S. 0&27'00.8" W. a distance of 2,645.4i feet, said southwest comer being monumemed with a brass cap on a 2" pipe; thence S. 04001'26.6'' E.a distance of 2,653.23 feet to a point on said survey line of highway and THE TRUE POINT OF BEGINNING; thence with a parallel right-of-way line 41.97 feet to the left or northerly side and the presently existing northerly right-of-way boundary of Wyoming State Highway No. 237 being the right or southerly boundary of this parcel, S. 89035'38.5'' E. a distance of 308.66 feet to the point of ending. The above described parcel of land contains 3,000 square feet, more or less. The basis for bearing is the west boundary of the SW¼ of said Section 32, it being S. 00°27'00.8" W. The grantor(s) will not construct, place, or cause any obstruction which would inhibit the flow of the irrigation waters and impede maintenance of the irrigation facility within the above described area. Grantor(s) also grant(s) the right of ingress and egress to and from the said land for any and all purposes necessary and incident to the exercise by the grantee, of the rights granted by this conveyance. Grantor(s) hereto do hereby waive(s) and release(s) all-rights under and by virtue of the homestead exemption laws of the State of Wyoming insofar as affected by this conveyance. The grant herein contained is an easement and shall be perpetual so long as the said land is used fbr the aforementioned purposes.
