Assessments are due to the Association on an ~ual basis. According to the Declaration of Coven~ts, Conditions and Restrictions for Co~iss~ Ranch ("the Decl~ation'), dined August 15, 1978, and recorded in the office of the Lincoln County Clerk on September 6, 1978, ~ Book 149 PR, page 95, recordhg of a Notice of Assessment and Lien for non-payment of assessments results in a lien on the prope~ of the lot o~er in favor of the Association. The Association may foreclose such lien by adve~isement and sale under the Declaration. Pursuit to ~e Decimation ~d this Notice of Assessment ~d Lien, ~e AssOciation has a Lien on the propeay of the lot omers ~ the amo~ts as set fo2h h the table below. The lot owners identified below have defaulted in the performance of the conditions and terms of the Declaration by failing to pay' the assessments when due, and thus, the power df sale h~s bedome 0p~ra~ive, and the Association has declared the entire balance owing for assessments and additional 'Charges to be immediately due and payable and elects to exercise the power t° foreclose the Lien by advertisement and sale as provided in the Declaration. No suit or proceeding has been instituted at law to recover the debts secured by the Lien or any part thereof.
