HomeMy WebLinkAbout897036 RECEIVED LINCOLN COUNTY OLERK This agreement, made this 1st day of August, 2003, by and between LaMont R. Merritt, Trustee of the LaMont R. Merritt Revocable Trust dated September 10, 1997, of PO Box 125, Afton, VVY 83110, and Max R. Merritt and Mary W. Merritt, husband and wife, of 647 AIIred Road, Alton, WY 83110, ("seller"), and Eugene J. Corson, a married man dealing in his sole and separate property, of PO Box 44, Afton, WY 83110, ("buyer"). WITNESSETH: That the seller agrees to sell and convey to the buyer, and the buyer agrees to purchase the following described real property, situate in the County of Lincoln, State of Wyoming, to-wit: A portion of the SE1/4SW1/4 of Section 23, T32N, R119W, 6th P.M, Lincoln County, Wyoming, more particularly described as follows' Beginning at point on the East boundary of said SE1/4SW1/4 that is 200 feet North of the SE corner of said SE1/4SW1/4 and running thence North along said East boundary 1,120 feet, more or less, to the NE corner of said SE1/4SW1/4; thence West along the North boundary of said SE1/4SW1/4 575 feet; thence in a Southeasterly direction approximately S19°39'13"E 1,189.29 feet, more or less, to a point 175 feet west of the point of beginning on a line parallel with the South boundary of said SE1/4SW1/4; thence East parallel with said South boundary 175 feet, more or less, to the point of beginning. TOGETHER WITH a perpetual, nonexctusive right of way easement for ingress and egress and all utilities from AIIred Road to the above described property described as follows: Beginning at a point on the east boundary line of said Section 23 which is 4 rods north of the Southeast Corner of Section 23, T32N, R119W, 6th P.M., Lincoln County, Wyoming, and running thence North along said boundary line 6 rods; thence West parallel to the South boundary line of said Section 23 160 rods, more or less, to the East boundary line of said SE1/4SW1/4; thence South along said East boundary line 4 rods; thence East parallel to said South boundary line 142 rods; thence approximately S83°39'35"E 18.11 rods (298.83 feet), more or less, to the point of beginning. The grant of this easement is on condition that buyer (grantee) shall be responsible for construction of any bridge(s) or other improvements necessary to use the easement, generally for maintenance of the easement and to construct and maintain fences or cattle guards for control of livestock grazing on land where the easement is located. 08 }?OLiS SUBJECT TO all covenants, easements, reservations and rights-of-way of sight or record. exceptions, restrictions, THE PURPOSE OF THIS CORRECTION REAL ESTATE CONTRACT IS TO CORRECT THE DATE OF THAT CERTAIN REAL ESTATE CONTRACT DATED JANUARY 15, 2001, AND RECORDED IN THE OFFICE OF THE LINCOLN COUNTY CLERK ON DECEMBER 12, 2003, IN BOOK 543 PR, PAGE 729, RECORDING NO. 895886. 1. A Real Estate Sales Agreement of even date containing the complete conditions, covenants and terms governing this transaction is now in full force and effect; and those conditions, covenants and terms not specifically recited in this agreement, but recited in the Real Estate Sales Agreement referred to, are incorporated herein by reference. 2. Any and all interest, right or title acquired in the above described real property by virtue of subsequent transactions with the undersigned seller will be wholly subject to the right, interest and equity of the undersigned buyer in such real property arising by virtue of this contract and the aforementioned Real Estate Sales Agreement. 3. In the event of buyer's default under the Real Estate Sales Agreement referred to and forfeiture of buyer's interest in the described premises pursuant to the terms of the Real Estate Sales Agreement, an affidavit by seller, or their agent, showing such default and forfeiture and recorded in the County Recorder's Office of Lincoln County, Wyoming, shall be conclusive proof in favor of any subsequent bona fide purchaser or encumbrancer for value of such default and forfeiture, and buyer hereby irrevocably authorizes seller or their agent to declare and record such default and forfeiture and agrees to be bound by such declaration as his act and deed. iN WITNESS WHEREOF, the said parties to this agreement have hereunto signed their names as of the day and year first aboVe written.
