That WE, the undersigned, Alan L. Motzkus and Sharan Motzkus, Husband and Wife as
Tenants by the Entireties with full rights of survivorship, ("Grantor"), for a good and valuable
consideration, the receipt of which is hereby acknowledged, do hereby grant, convey and warrant
unto Lower Valley Energy, a Cooperative Corporation, of Alton and Jackson, Wyoming and to its
successors and assigns, ("Grantees"), a perpetual easement and right of way for the construction and
continued maintenance, repair, alteration and replacement of the electric distribution circuits, lines
and equipment of the Grantee to be constructed and maintained under, upon and across the premises
of Grantor in LINCOLN County, State of WYOMING along a line described as follows, to wit:
BEING a portion of the Real Estate Contract recorded in Book 332PR, on Page 19 and the
Amendment to Real Estate Sales Agreement and Real Estate Contract recorded in Book
343PR, on Page 173, with the Office of the Clerk of Lincoln County, Wyoming, NE1/4 of
Section 33, T34N, Rll8W, of the 6th P.M., Lincoln county, Wyoming, being 20 feet in width,
the Centerline being more particularly described as follows:
BEGINNING at a Power Pole, said Point of Beginning, being 631.27 feet S 70° 03' 14" E from
the B.L.M. type Monument marking the Paul N. Scherbel RLS 164, 1972 location for the
Northwest Corner of said NE1/4; thence S42° 07' 07" E, 3,121,02 feet to a Power Pole.
Together ~ith all necessary and reasonable rights of ingress and egress and to excavate and refill
ditches and trench for the location and repair of said facilities and to cut, trim, or remove trees,
shrubbery, undergrowth or other obstructions interfering with the repair and maintenance of the
facilities. The Grantor acknowledges that Electric and magnetic Fields (EMF) are naturally
occurring in the distribution of electricity, and the Grantee has here notified Grantor that EMF testing
and information is available upon request from the Grantee. The undersigned agrees that all wires
and other facilities, installed on the above-described lands at the Grantee's expense shall remain the
property of the Grantee, removable at the option of the Grantee. We hereby release and waive all
rights under and by Virtue of the Homestead Exemption Laws of the said State.
