MORTGAGE
THIS MORTGAGE, made effective as of the first day of August, 1997, by and between Eloise
Stokes, whose address is 6426 South 1650 East, Salt Lake City, Utah 84121 (the "Mortgagor"),
and Stokes 59, Inc., an Idaho corporation, whose address is 217 South State Street, Preston,
Idaho 83263 (the "Mortgagee").
WlTNESSETH
That to secure payment of the sum of Sixty Two Thousand Five Hundred and Fifty Two
and 89/100 Dollars ($62,552.89) with interest at the rate of Six Percent (6%) per annum which is
payable in monthly installments, as evidenced by that certain Promissory Note of even date
herewith made by Mortgagor, Mortgagor does, by these presents mortgage, convey and warrant
unto the said Mortgagee the property situated in the County of Lincoln, State of Wyoming,
described as:

Lots 3 6 and 37,Star YalleyRanch, a rec0rded~ platted subdivision.
The Mortgagor agrees to pay the indebtedness hereby secured and to pay all taxes and
assessments on said premises and to keep the property thereon insured in a stun of not less than
the amount financed during the life of this Mortgage. In case the Mortgagor shall fail to pay
such taxes, assessments or insm'ance premiums required to be paid by the Mortgagor, the
Mortgagee shall pay the same and all sums so paid shall be reimbursed to the Mortgagee within
thirty (30) days after notice thereof has been sent to the Mortgagor by first class mail with
postage prepaid. Each such advancement shall be considered a part of the above indebtedness
hereby secured and shall draw interest at the same rate.
In case default shall'be made in the payment of the above sum hereby secured, or in the
payment of the interest thereon or any part of such principal or interest or advances, when the
same shall become due, or in case default shall be made of any of the covenants and agreements
hereof or under the promissory note, then the whole indebtedness hereby secured with interest
thereon shah become due and payable at once and the Mortgagee or its legal representatives or
assigns may proceed to foreclose, by advertisement and sale pursuant to the laws of the Sate of
Wyoming, and sell said property, and out of the proceeds of such sale they shall pay all sums due
hereunder together with all costs of the sale and foreclosure including a reasonable attorney's fee.
IN WITNESS WHEREOF, the Mortgagor has caused its hand and seal to be hereunto
