HomeMy WebLinkAbout899152MEMBER # 395615 WORK ORDER #18731 BOOK_ Section 34, T33N, Rll9W ELECT~C DIST~BUTION EASEMEN ~OW ALL MEN BY THESE P~SEN~:~ That ~, the underrated, 2 he Dean and Eldena Grover Llwng Trnst, 1998, and any amendments thereto, ( Gr~tor ) for a good and valuable cons~deratton, the receipt of which is hereby aclmowledged, do hereby ~ant, convey and wan'ant unto Lower Valley Energy, a Cooperative Co~oration, of Aflon and Jackson, Wyoming and to its successors and assigns, ("Grantees"), a pece~al easement and right of way for the construction and continued maintenance, repair, alteration ~d replacement of the electric distribution circuits, lines and equipment of the Grantee to be constructed and maintained under, upon and across the premises of Grantor in Lincoln Count, State of Wyoming, along a line described as follows, to wit: BEING a portion of the SE1/4SW1/4 of Section 34, T33N, Rll9W, 6"' P.M., located West of Auburn, Lincoln County, Wyoming more particularly described as follows: COMMENCING at an iron pipe set N 0° 19' 10" E, along the East line of said SE1/4SW1/4} 502.66 feet from a Brass Cap monument marking the SE corner of said SE1/4SW1/4; Thence rtmning N 89° 40' 50" W, 14 feet to an iron pipe set near an East-West fence line; Thence running N 89° 40' 50" W, 367.16 feet to an iron pipe found near a fence corner post in the Southwesterly fence line of a road; ThenCe N 38° 23' 01'? E, along said fence line 161.92 feet to true point of beginning; Thence N 38° 23' 01" E, 81.81 feet; Thence N 10° 19' 33" E, 275.27 feet; Thence N 32° 27' 55" E, 112 feet to an existing prover pole. Easement to include a strip of land 20 feet in width running parallel with above described line. Together with all necessary and reasonable rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of said facilities and to cut, trim, spray herbicides, or remove trees, slmtbbery, undergrowth or other obstructions interfering with the repair and maintenance of the facilities. The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occuning in the transmission or distribution of electricity, and that the Grantee has here notified Grantor that EMF testing and information is available upon request from the Grantee. This Easement by Grantor is intended to include so much space as is necessary or appropriate to the presence of EMF and reasonable operation of the Grantee's transmission or distribution lines. The undersigned agrees that 'all wires and other facilities, installed on the above described lands at the Grantee's expense shall remain the property of the Grantee, removable at the option of the Grantee.
