'"''~ STATE OF WYOMING COUNTY OF LINCOLN SS. Quinn R. Heiner, of PO Box 224, Thayne, WY 83127, upon his oath deposes and says: 1. That he makes this affidavit as his recorded statement, duly verified, pursuant to the provisions of W.S. 34-2-123 and in connection with the following described real property located in Lincoln County, Wyoming: (1) Real Property acquired pursuant to that certain Warranty Deed dated October 22, 1996, and recorded November 21, 1996, in Book 390 PR, page 759, in which the grantor is Maxine F. Heiner, as Trustee of the Glenn W. Heiner Family Revocable Trust dated January 15, 1992, described as follows: PARCEL C as depicted on a Record of Survey plat map for Glenn W. and Maxine F. Heiner, prepared by Lloyd B. Baker, Wyoming PE/LS 698, and dated June 10, 1996; ALSO DESCRIBED as being a portion of the SE1/4SE1/4 of Section 7, T34N, R118W, 6th P.M., more particularly described as follows: Beginning at a point on the South line of said SE1/4SE1/4, said point being 770.42 feet S89°14'11"W, from the Southeast corner of the SE1/4SE1/4; thence running S89°14'11"W, along last said South line, 385.20 feet; thence N0°00'19"W 226.20 feet; thence N89°14'11"E 385.20 feet; thence South 226.20 feet to the Point of Beginning, containing 2.000 acres of land. Subject to all easements, exceptions, restrictions, reservations and rights of way of sight or record. (2) Real Property acquired pursuant to that certain Warranty Deed dated December 1, 1996, and recorded January 16, 1998, in Book 406 PR, page 624, in which the grantor is MaxineiF. Heiner, as Trustee of the Glenn W. Heiner Family Revocable Trust dated January 15, 1992, described as follows: The NE1/4NW1/4 of Section 8, T33N, R118W, 6th P.M., Wyoming. TOGETHER WITH that certain Right-Of-Way Easement Agreement dated June 9, 1996, given by Bruce E. Robinson and Joyce Robinson, husband and wife, grantors, more particularly described on the attached "DESCRIPTION - CENTER LINE OF 60 FOOT WIDE HEINER ROAD EASEMENT", a description signed by Lloyd B. Baker. TOGETHER WITH a perpetual right-of-way easement for ingress and egress and all utilities for the benefit of grantees and their heirs and assigns, described as an existing road that meanders through the SW1/4SE1/4 and SE1/4SW1/4 of Section 5 and the NEI/4NWI/4 and SEI/4NWI/4 of Section 8, T33N, R118W, 6th P.M. SUBJECT TO and EXCEPTING and RESERVING unto Grantor a right-of-way easement for ingress and egress and all utilities described as an existing road meandering through the NEI/4NWl/4 of Section 8, T33N, R118W, 6th P.M., for the benefit of the SWI/4NEI/4 and SEI/4NWI/4 of said Section 8. (3) Real Property acquired pursuant to that certain Warranty Deed dated September 7, 2000, and recorded September 14, 2000, in Book 452 PR, page 017, in which the grantors are Evan Glenn Heiner and Leslie C. Heiner, husband and wife, described as follows: A portion of the SE1/4NWI/4 of Section 8, T33N, R118W, 6th P.M., Lincoln County, Wyoming, more particularly described as follows: Beginning at the northeast corner of said SEI/4NWI/4 and running thence West along the North boundary line of said SEI/4NWI/4 1320 feet, more or less, to the Northwest Corner of said SEI/4NWI/4; thence South along the West boundary line of said SEI/4NWI/4 1320 feet, more or less, to the Southwest Corner of said SEI/4NWI/4; thence approximately N45°0'0"E 1866.76 feet,, more or less, to the point of beginning. TOGETHER WITH that certain Right-of-Way Easement Agreement dated June 9, 1996, given by Bruce E. Robinson and Joyce Robinson, husband and wife, grantors, more particularly described on the attached "DESCRIPTION - CENTER LINE OF 60 FOOT WIDE HEINER ROAD EASEMENT", a description signed by Lloyd B. Baker. TOGETHER WITH and SUBJECT TO a perpetual right-of-way easement for ingress and egress and all utilities described as an existing road meandering through the SW1/4SE1/4 and SE1/4SW1/4 of Section 5 and the NEI/4NWI/4 and SEI/4NWI/4 of Section 8 all in T33N, R118W, 6th P.M., for the benefit of the SWI/4NEI/4, E1/2NW1/4 and NWI/4NWI/4 of Section 8, T33N, R118W, 6th P.M. 282 SUBJECT TO all covenants, easements, exceptions, restrictions, reservations and rights-of-way of sight or record. (4) A one-fourth (1/4) undivided interest in and to the real property acquired pursuant to that certain Warranty Deed dated June 24, 2002, and recorded June 28, 2002, in Book 493 PR page 384, in which the grantor is Salt River Hereford Ranch, a Wyoming Corporation, described as follows: N1/2NE1/4 of Section 18, SW1/4SE1/4 of Section 7; NWl/4 and N1/2SW1/4 of Section 17, all in T33N, R118W of the 6th P.M., Wyoming. Together with an easement for access as disclosed by Affidavit Certificate of Owner as recorded March 12, 2001, in Book 460 P.R., page 738-739. Together with an easement for the South 60 feet of that certain parcel of land described in Warranty Deed recorded February 13, 2001, in Book 459 P.R., page 454. Subject to reservations and restrictions contained in the United States Patent and to easements and rights-of-way of record or in use. Together with all improvements and appurtenances thereon. (5) A one-fourth (1/4) undivided interest in and to the real property acquired pursuant to that certain Warranty Deed dated June 25, 2002, and recorded June 28, 2002, in Book 493 PR, page 385, in which the grantors are Morris W. Heiner and 'Florence K. Heiner, Trustees of the Morris W. Heiner Family Trust dated the 23rd day of June, 1998, described as follows: The S1/2NE1/4, SE1/4NW1/4 and Lot 2, Section 18, T33N, R118W of the 6th P.M., Wyoming. Together with that certain Easement dated the 18th day of February, 1965, and recorded March 6, 1968, in Book 82 PR, page 94, a perpetual right-of-way for ingress and egress on a roadway not to exceed one rod in width across the North end of the Sl/2NWl/4 of Section 17, T33N, R118W of the 6th P.M., Wyoming. Subject 'to reservations and restrictions contained in the United States Patent and to easements and rights-of-way of record or in use. Together with all improvements and appurtenances thereon. (6) Real Property acquired pursuant to that certain Special Warranty Deed dated April 12, 2002, and reco'rded May 1, 2002, in Book 488 PR, page 612, in which the grantor is F.A.T. Investments Limited Partnership, a Wyoming Limited Partnership, described as follows: Township 33 North, Range 118 West, 6th P.M., Lincoln County, Wyoming: Section 8: SW1/4NWI/4 TOGETHER WITH any and all interest in and to that certain Common Easement Agreement dated August 23, 1978, and recorded in the office of the Lincoln County Clerk on November 17, 1978, in Book 150 PR, page 694. SUBJECT TO all covenants, conditions, easements, restrictions, reservations and right-of-way of sight or record, including, without limitation that certain Property Boundary Agreement recorded in the office of the Lincoln County Clerk in Book 485 PR, page 087. TOGETHER WITH the non-exclusive right to utilize for roadway purposes an easement acquired pursuant to that certain Quitclaim of Easement dated April 1, 2003, and recorded May 2, 2003, in Book 519 PR, page 614, in which the grantor is F.A.T. Investments Limited Partnership, a Wyoming limited partnership, described as follOws: A right-Of-way eaSement over, across and along a strip of land 30 feet in width, said 30 foot wide strip of land being 15 feet each side of the centerline of an existing road or roadway extending from the Strawberry Road to lands of Charles G. Heiner and Ellen H. Heiner in the SE1/4SE1/4 of Section 6, T33N, R118W, 6th P.M., Wyoming, and the centerline of said road or roadway being more particularly described as follows: Beginning at the intersection of the Strawberry Road with .the centerline of an existing road (said intersection being in Section 21, T34N, R118W, 6th P.M., Wyoming, and being approximately 1¼ mile along the Strawberry Road from the U.S. 89 Highway)'and running in a Southerly direction along the Centerline of said existing road, through the lands of LeRoy L. Heiner and wife, approximately one- half (1/2) mile to the South boundary line of said Section 31, T34N, R118W, 6th P.M., Wyoming, thence in an East - South - easterly direction, through the lands of Joseph A. Heiner, Jr. and wife, approximately 20 rods through the Northeast Corner of the NWI/4NWI/4 of Section 6, T33N, R118W, thence through the lands of LeRoy L. Heiner and wife in the NEI/4NWI/4 of said Section 6, in an East - Southeasterly direction, approximately 40 rods, thence through said lands in a South - SoutheaSterly direction approximately 130 rods to the North boundary line of the lands of Charles G. Heiner and wife in the'S1/2 SWI/4NEI/4 of aid Section 6, thence through said lands and NWI/4SEI/4 of said Section in a South - Southeasterly direction approximately 110 rods to the Northeast corner of the Forrest Joel Heap and Wife property and East boundary line of the NWI/4SEI/4 of said Section 6, thence along the West boundary line of the Joseph A. Heiner and 4 Sara Heiner lands, in the NEI/4SEI/4 of said Section 6, approximately 460 feet to the North boundary line of the SE1/4SE1/4 of said Section 6, and North boundary line of the Charles G. Heiner and wife property in said SE1/4SE1/4, and extending 30 feet each side of the centerline of said described roadway, as shown on the Exhibit "A" attached hereto and by this reference made a part hereof. The easement granted herein shall be used exclusively to access not more than four single family home sites. 83127. That his name and address are Quinn R. Heiner, PO Box 224, Thayne, WY 3. That he is one of the grantors and trustees in the Quinn R. Heiner and Carolyn S. Heiner Family Revocable Trust dated May 16, 1997, that Carolyn S. Heiner became deceased on November 11, 2002, that upon the death of Carolyn S. Heiner he became the sole trustee of the Quinn R. Heiner and Carolyn S. Heiner Family Revocable Trust dated May 16, 1997, including its ownership of the real property described in paragraph 1above, and that he is currently lawfully serving in that capacity. 4. That he hereby verifies that the information contained in this affidavit is true and correct according to his information and belief. DATED as of the 7th day of January, 2004.
