Robinson, Tru§'te~'S'~¢: t'l~!~ Bh]~'6!~!'"Robinson and Joyce F Robinson Family Revocable Trust dated October 30, 1997, of 270 Robinson Lane Lincoln County Road No. 12-124, Bedford, WY 83112, grantors, for and in consideration of.'fen Dollars ($10.00) and other valuable consideration in hand paid, receipt of which is acknowledged, grant and convey to Carl S. Heiner and Darlene F. Heiner, Trustees of the Carl S. Heiner Family Revocable Trust dated October 6, 1992, of 871 Lincoln ~ounty Road No. 123, Bed~ford, WY 83112, grantees, the followihg'described perF.,etual right-of-way easement for the following purposes: 1. Purpose of I-Zasement. This easement is for the purpose of providing a perpetual, nonexclusive 60-foot wide ,, right-of-way easement for ingress and egress and all underground utilities to the properly described in paragraph 3 from the Bedford-Turnerville Lincoln County Road No. 12-123, including the right to construct and maintain a roadway to provide that ingress and egress and for all undergroun'd utilities. 2. Conditions' of this Easement. The conditions of this easement are: a. The easement may not be fenced by Grantees without the prior Written consent of G"-antors. b. Neithe[ Grantors nor Grantees have any duty to construct, operate, or maintain any roadway or underground utilities constructed in the described easement. Grantees are responsible for the cost of construction of any road or utilities and the cost of the subsequent operation and maintenance of such improvements whiSh Grantees, in their sole discretion., determine to make for the benefit of Grantees' Isnds described in paragraph 3 below. Grantors are responsible for the cost of construction of any road or utilities and the cost of the subsequent operation and. maintenance of such improvements which Grantors, in their sole discretion, determine to make for the benefit of Grantors' lands. However, if Grantors and Grantees agree to construct a road or utilities in the easement for the mutual benefit of Grantors' lands and Grantees' lands, then Grantors and Grantees 488 shall each be responsible for their reasonable share of the cost of such construction and the subsequent expenses of operation and maintenance. 3. Property Benefited by Easement. This easement is for the benefit of the following described real property of the Grantees in Lincoln County, Wyoming: W1/2NE114NE1/4 (Lot 1), W112SE1/4NE114, SWI/4NE1/4 and E112NW114NE114 (Lot 2) of Section 5, all in T33N, R118W of the 6th P.M. Wyoming. 4. Description of Easement. The easement is described as follows: A portion of the prcperty as referred to in the Deed recorded in Book 406PR, on Page 424, with the Office of the Clerk of Lincoln County, Wyoming, within Lot 1 (NE1/4NE1/4) of Section 5, T33N, R118W, of the 6th, P.M. Lincoln County, Wyoming, being mo~'e padicularly described as follows: BEING the North 6Ofeet of the East 663.47 feet of said Lot 1. 5. Binding Eff6,ct. The terms and conditions of this easement shall be binding upon and inure to the benefit of tl~e heirs, successors in interest and assigns of the parties named in this instrument. 6. Waiver of Hr~mestead Rights. The Grantors hereby waive and release all rights to the deScribed easement u~der and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purposes of this easement. Robinson to me personally known, who, being by me duly sworn and put upon their oath, did say that they are the trustees of the Bruce E. Robinson and Joyce F. Robinson Family Revocable Trust dated October 30, 1997, described in and which executed the foregoing instrument; that said instrument was signed and sealed on behalf of said trust; that said trustees had the authority under the terms of the written trust instrument to execute the instrument on behalf of the trust; and said trustees acknowledged said instrument to be the free act and deed of said trust.
